'V* ' Agreements To Marry What can n woman do if a man ; wrongfully breaches his promise to marry her ? L In most states, including North * Carolina she may sue the man for breach of contract and recover a judgment for damages. She cannot get a court order re quiring the man to go through a wedding ceremony with her. There • are no exceptions to this rule. One of the essential elements of a valid | marriage would be lacking if a man should be forced by court decree or f, otherwise to enter into a marriage against his voluntary consent. The amount of damages to be ! recovered depends upon the wealth of the defendant, the mortification and mental pain suffered by the plaintiff, expenses incurred in preparation of the marriage, injury to plaintiff’s reputation, and other things. The woman is not obligated to return the engagement ring if the donor refuses to carry out his promise without legal justification. In almost a third of the States there have been enacted statutes barring actions for breach of prom ise to marry. They have been call ed “anti-heart balm statutes.” No such statutes have been passed in North Carolina and states border ing it. Woman with wealthy suitors should maneuver to have their pro posals occur in states where “anti heart balm statutes” do not exist. The validity of a contract is de termined by the law of the state where it is made. May a man recover damages from a woman who breaches her contract to marry him? Yes. Does the law require that an en gagement agreement be in any par ticular form? No. If the conduct and declara tions of the parties clearly indi cate that they regard themselves as engaged, it is immaterial as to hy what means they have arrived at that state. The woman’s uncor roborated testimony may be suf ficient to prove the agreement. May a suit for breach of promise to marry be brought against a per son less than twenty-one years of age? No. Minors are not liable gen early on contracts other than for | necessaries. Marriage is not a ne cessity. This does hot prevent,! however, a minor from suing a de fendant who is of full age. If no time for the wedding has been fixed, when must the marri age occur? Where no time for the wedding has been fixed, failure to perform within a reasonable time may lie considered a breach. The reason ableness of time depends upon the circumstances of the particular case. A mere request for the postpone ment of the marriage ceremony for reasonable cause does not amount to a repudiation or breach of the contract to marry, for each party has a right to a reasonable delay . without reason or beyond reason. May a man be sued for breach of promise if he discovers that the woman has had sexual relations with another? No. The unchastity of the wo man, if unknown by the man at the time of the promise, is a complete defense for breach of promise to marry in North Carolina. There is a waiver of the defense if the man renews his promise after acquiring knowledge. World Working Population Now Over One Billion The world has a working popu lation of more than a billion per sons, according to information com piled by the International Labour Office, an affiliate of the United Nations Organization. Two out of every five persons of the earth’s present population of about 2.7 billion persons are de scribed as economically active in their contribution toward the pro duction of goods and services for home consumption or for trade be tween nations. They are of vary ing ages, capabilities, occupations and skills. At one extreme are a child and his grandparents classed as unpaid workers in small-scale farming and other family enter-, prises, still the source of much of the world’s work, because of low capital formation in many coun tries. At the other extreme are the craftsman and executive in the United States and other highly in dustrialized nations. Importance of Investment The American labor force comes to only about 6 per cent of the world total. Because of the ad vanced state of industrialization, however, high savings and invest ment, and steadily rising produc tivity the American economy turns out nearly one-half of the world’s factory-produced goods and con sumes more than a third of the world’s goods and services. The United States labor force participation rate is about the same as that for the world as a whole— two out of five of the total popula tion. However, the rate shows some wide variations from one part of the world to another, depending on such factors as the extent of economic and industrial develop ment, social customs ar.d traditions that tend to govern the make-up of the labor force, and the general age composition of the population. The Middle East is a case in point. The number of persons de fined as gainfully occupied in this part of Asia adds up to less than a third of the area’s total popula tion, according to the latest esti mates. Situation in Africa Tropical and Southern Africa, on the other hand, has the highest rate in the world, with about half the entire population classed as economically active. Here the high j proportion of very young people in | the population is offset by the wide 1 prevalence of child labor under the comparatively primitive conditions! that still exist in much of that' area. Though the composition of the working population may vary from one country to another, the adult male is still the predominant work er and bx-ead-winner. Men between the ages of 20 and 64 are the big gest single element in the work force everywhere.
