Bar Association) <r— 11 ■ Insane Persons May an insane person be sued for the damages that he has caus ed to the property or person of an. other? Yes. An insane person is liable in a civil action for the actual dam ages that he has caused to the property or person of another. You may, for example, recover compensatory damages from an in sane person if he destroys your property, steals your property or wrongfully converts it to his use, trespasses i pon your property, or causes bodily injury to you. It has even been held that an action for wrongful death may he brought against one who is insane. There has been said to he noth in ing wrong or unjust in giving com pensation for the actual loss re sulting from an injury inflicted by a lunatic. Punishment is not the object of a civil action; it has for its object the compensation of the party injured. If an insane per son is not held in a civil action for damages, those interested in his es tate, as relatives or otherwise, might not have sufficient motive to so take care of him as to de prive him of opportunities for in flicting injuries on others. An insane person is not liable, i however, for those torts or civil wrongs of which malice is an es sential element, such as libel and slander. Punitive damages can never be recovered against an in sane person. : May an insane person he con victed of a crime? No. The law does not punish a person in a criminal proceeding if he was so insane at the time the act was done as to he incapable of determining between right and wrong. k . The law presumes every person sane. The defendant who relies j upon insanitav as a defense must introduce evidence of his insanity. What happens if a person com mits a crime while sane but sub sequently becomes insane before the date of his trial? This fact does not render him not guilty of the crime. Rut he cannot be arraigned and tried while he is insane. The reason is that an insane person cannot properly defend himself. Such insanity, however, does THANK YOU... One night among the old gnarled olive trees, the Lord talked to me about healing one’s enemy. And there where he had done this he gave me this picture. A mob came sweeping into the garden. It was led by Judas Is cariot. They had come to arrest t Jesus. The disciples were badly frightened and Peter whipping out his sword made a big sweep and cut off the ear of Malchus, the high priest’s servant. The only reason he didn't cut his head off was because he missed! But instantly Jesus touched Mal chus and healed him. Here, in one dramatic mo ment. is the hand of man against man, enemy fighting enemy, and the hand of God healing the en tmy Malchus’ hands were reaching for Jesus when Peter's sword-filled hand struck at him. Jesus could have called many le gions of angels to cut his ene mies down. Instead he. rebuked Peter, telling him to put up his sword Then he reached forth his hand and touched Malchus and healed him. What drama! What incompar able meaning’ The last act per formed by the hands of Jesus be fore they were tied before the cross was to stretch them forth and heal the ear of a man who was directing his arrest. The lesson is unforgettable. Our hand should never be balled into a fist, but stretched forth to heal and to liless. Whenever you allow anything, no matter how severe, to bring prejudice. not prevent his being tried and | punished if he subsequently be-; \ comes sane. ! A sane person properly executes a will. Subsequently he becomes insane and continues so until his death. Is his will valid? Yes. A month later he died suddenly. After the funeral she said. "I am so glad he did not die before 1 asked his forgiveness."
