Rood Grant”, issued to the
Elizabeth City Chamber of
Commerce by the N.C. Arts

WASHINGTON—It's impossible to say with certainty
whether HEW Secretary Califeno and h>s bureaucrats have
actually backed down, even a little bit, in their campaign of
harrassment of the Consolidated University. My own guess
is that- Bill Johnson, chairman of the Board of Governors of
the University, is on sound ground in his feeling that the
recent "settlement" was nothing more than a temporary
retreat by HEW—if indeed it was a retreat at all.
There's no question about the impact that the people
of North Carolina had on Mr. Califano. On this issue, the
citizens of our state are almost unanimous in their resentment.
And it speaks well of our people that they are.
Mr. Califano "got the word"—and that is unquestionably
why he and his bureaucrats have gone through the motions of
trying to appear conciliatory.
LULL—No one should be lulled to sleep, because what
is at stake in this matter is the survival of academic freedom. If
Mr. Califano and his bureaucrats can get away with harrassing
and intimidating the University of North Caroline, they can
get by with it everywhere. This must not be allowed to happen.
Last year, I introduced legislation designed to protect
private and public colleges and universities from precisely
this type of abuse by the federal bureaucrats. My bill is entitled
"The Academic Freedom Act," and if and when Congress
enacts it, the federal bureaucrats will be barred from ordering
any college or university to take any action which would tower
academic requirements.
And it would prevent HEW from cutting off funds to
the University of North Carolina—or any other college or
university—until the legality of such HEW action is upheld
by the courts.
YEAR—I introduced that bill a year before Secretary
Califano began to tighten the bureaucratic screws on UNC.
Last Fall, i introduced another bill—this one called ‘The
Freedom of Choice in Education Act"—which would provide
simply that when a college or university has complied with an
HEW plan (as UNC has already done), the school can go into
a court and ask a jury to determine whether the institution
is in compliance.
And if the jury finds that the college or university has
indeed followed the law, then no federal judge could thereafter
order quotas for either faculty or students. The administrators
of the college or university—not HEW nor any federal judge—
would be solely responsible for making decisions about new
programs, new buildings, etc. In other words, my bill would
restore to the college or university officials their right to run
their institutions. The federal judges and the federal bureau
crats would have to get their noses out of the school's business.
CALIFANO—At one point in his dispute with UNC,
Secretary Califano pleaded, not very persuasively, that he
didn't really want to harrass UNC, but that he was "forced"
to do so by law. That's hogwash.. If Mr. Califano does not
really like what he says he is "forced" by the law to do, all
he has to do is to encourage Congress to enact my two bills.
Scores of leading college and university officials all
across the country have endorsed my bills. But when was the
last time you recall a federal bureaucrat recommend that he
be allowed to surrender any of his controls?

in the public interest.
“Its social advantages
outweigh the alleged
disadvantages which have
been volunteered by its
detractors,” the industry
said as it filed reply com
ments in an FCC inquiry on
the proposal, known as the
Primary Instrument
Concept. What the Primary
Instrument Concept does,
the industry said, is offer a
reasonable balance between
customer choice in- the
x selections of telephones and
the need for continued
reliability in service.

interest benefits. Most do
not even address
them.
The industry filing points
out that the Primary In
strument Concept is con
sistent with past FCC
decisions because it allows
connection of any and all
types of terminal equipment
meeting the requirements of
