In order that we may have the fullest cooperation while serving as the Presiding Judge in your County I endow herewith Rules of Courtroom Civility *nd Pro ceedings for you as the High Sheriff of Cherokee County. I request that you call in your Courtroom deputies, as well as your other deputies, and explain these rules to them, so that they will be fully acquainted with same and prepared to enforce them in detail when I come there for my first court this fall. These rules are fairly simple and easy to enforce when you, the Courtroom deputies and your other officers get used to them. About all they amount to is hav ing order, decorum, and quiet in the Courtroom, so that your courts may be efficiently operated and with as little expense as possible to the taxpayers. 1 shall expect these rules to be strictly enforced by you, and do not want to have to remind you or your Courtroom deputies to en force them. No officer who ne glects to carry them out or isl lax about their enforcement will be permitted to continue to act as Courtroom deputy. I have today written the Clerk of Superior Court of your Coun ty. advising him as to certain duties which you will perform with him shortly before the open ing of our first term of Court in order that all matters may be worked out between the two of VAI1 Please acknowledge the receipt I of this letter' together with a copy of the rules enclosed, at your earliest convenience. Resident Superior Court Judge of the 28th Judicial District Box 7375, Courthouse Station Asheville, North Carolina 50-2tc RULES OF COURTROOM CI VILITY AND PROCEDURE FOR SHERIFF OF CHEROKEE COUNTY, THIRTIETH JUDI CIAL DISTRICT. W. K. Mc LEAN. JUDGE PRESIDING, SUPERIOR COURT TERM JULY 25. 1960. The High Sheriff of Cherokee County, when he does not per sonally perform the duties of Courtroom Officer, shall assign such duties to a regular deputy, or deputies, who shall be alert, intelligent, and well-trained of ficers, who are capable of main taining order in the Courtroom at all times, and who shall wear a uniform- if the officers of the County wear uniforms; and if the officers of the County do not wear uniforms, then such officer, or officers, assigned to Courtroom duty shall be neatly dressed, and wear a coat, collar, and ties at all times. The High Sheriff of the County, or Courtroom deputies, or both, if necessary as well as all othf deputy sheriffs, shall observe and strictly enforce the followsing 1. The Sheriff, or a Courtroom Officer, shall remain in the Court room at all times while Court is in session, and shall either stand or be seated near the Judge, and shall remain alert and devote their attention exclusively to the operation of the Court and the enforcement of these rules. 2. The Sheriff, or Courtroom Of ficer, or both, shall see that ord er and quiet is maintained in the Courtroom at all times while Court is in session, and at any recess taken- and until the Court adjourns for the day. And. in addition to the foregoing two rules, it shall be the further duty of the Sheriff, or Court room Officer, or both, to see that the following rules are strictly ob served: (a i Shall not permit any per son, either attorney, officer, or spectator, to talk or engage in conversation while the Court is in session- except the attorneys, parties, and witnesses actually en gated in the trial of a case. Any Courtroom Officer who fails to see that this rule is strictly enforced will not be permitted to serve as a Courtroom Officer. (b) Shall under no circum stances permit any person, except attorneys, officers or official busi ness. and those engaged in the trial of a case, to enter the Bar at any time. (e> The Court will usually take a recess for a few minutes in the middle o I the morning and after noon sessions of Court, and at other times and when the Court does take a recess, it shall be the duty of the Courtroom Officer to annoounee, in open Court, at the time of the taking of any recess, that all- persons desiring to re enter the Courtroom shall do so within the time announced. I (f) There are times when the Judge leaves the Bench when not taking a regualar recess, and when this is done, it shall be the duty of the Courtroom Officer to maintain order ad quiet in the Courtroom in the same manner as if the Judge were on the Bench. <g> No person shall be allowed in the Courtroom with a child under six years of age unless such person bringing such child into Court is a defendant, a witness, or the husband or wife of a defendant. If any person com ing within these exceptions brings a child into Court and it begins to cry or becomes disorderly, such Courtroom Officer shall im mediately have such child remov ed from the Courtroom take the name of the case in which such party is interested, and then no tify such person when that case is called. And this rule shall be strictly enforced, without the Judge having to remind the Court room Officer to do so. <h> It shall be the duty of the Courtroom Officer to see that all jurors summonsed for the term are seated on the front rows, where they can conveniently come to the Jury Box when called. It shall be the further duty of the Courtroom Officer to see that all witnesses in the case on trial are seated on the front rows, or a! some place where they can con veniently come to the Witness Box. (I) It shall be the duty of the High Sheriff, or the Courtroom Officer, or other deputy, when a defendant is sentenced, to take him into immediate custody, and not release him from custody un til all of his fine and costs have been paid in full and every other provision of the judgment com plied with- if such sentence is a suspended sentence. (j) It shall be the duty of the High Sheriff to provide a space adjacent to the Courthouse where the Judge may conveniently park his automobile, and see that such space is not occupied while Court is in session. <k> The Courtroom Officer shall not permit any person to smoke, eat. drink soft drinks, or read newspspers inside the Courtroom at any time while Court is in session. (1) The Courtroom Officer shall not permit any person to remain in the Courtroom without being seated, except attorneys ad of ficers of the Court.
