These , provide him with an annual in come of around $20,000 and allow him to continue to receive maximum Social Security benefits. - The result of this situation is that the former clerk's opportunity to earn money is severly limited, irrespective of her needs (in reality, her lower life-long earnings will probably mean that she receives less Social Security than the re tired lawyer), ability, initiative and desire to do so. In this case, Social Security becomes, not a guaranteed annual in come, but guaranteed annual , poverty. While some would argue ' that the earnings test is an in- tegral part of the Social Security program, the original 1935 report by the House Ways and Means Committee did not contain such a stipula tion. Moreover, in the last few years Congress has increased the earnings ceiling. In the five years. 1972-1977. it has been raised from SI. 600 to $3,000 ( it is now tied to a cost of liv tng Index). With such consis tent nwvc.rncnt.tn favor of 1iberaHzihg the retirement test since 1 950 it will have in creased ., fivefold, Congress . should seriously consider the elimination" of this require- t mm.' C. Q few Congresses aimed at out right repeal, they have never got out of committee. It is therefore suggested ' that : Congress adopt, as . interim measures. two ' legislative changes which would bring significant improvement to the" current system. Reducing the penalty tor exceeding the earnings ? test would provide assistance to more than I , million older Americans. Last year, the Advisory Council of Social Security, a body mandated un der the Social Security Act to review tliis program's opera tions every four years, recom mended that the work penalty be reduced so that $1 in benefits would be lost for every $3 of earnings above the exempt amount to twice that figure, and $1 for every $2 above that. The "adequacy test" would represent another im provement. This would allow an individual to receive Social Security and work without suffering any decrease in his payment level up to the point where his Social Security in come and earnings equal the government's moderate budget level for an individual , (or family, if that is involved). Surely it is not asking too much of our ejected leaders to make it possible for older people to have sufficient in come to live on a "moderate budget level."
