The proceeding propos ed by the FTC's Bureau of Competition would focus on a rule that would pro hibit physician organiza tions from participating in the control of such plan. The draft rule would also temporarily limit the ex tent to which individual physicians participate in controlling the plans. The staff's recommen dation came as part of a 409-page report that is the product of a three-year in vestigation by the Bureau of Competition into the extent, impact and legality of medical control of Blue Shield and similar plans. The report marks the first time the Commission staff has recommended rulemaking, as a means of antitrust enforcement. If the Commission decides to underake a rulemaking, the draft rule would be the subject of public, comment and public hearings. The record in the proceeding would form the basis for the Commission to decide whether or not to pro mulgate a rule and, if so, what the provisions of the rule would be. Rulemak ing proceedings may take several years. The staff's investigation disclosed that physicians control decisions concern ing payment to physicians, coverage, or benefits in most of the nation's 70 Blue Shield plans. As of 1978, physician organiza tions selected the majority of members of the govern ing boards of 32 plans, and physician-contrdlled ' committees supervised or i1. particpafinVdsM about payments g. and claims in 67 plans. The report notes that in documents received dur ing the investigation, medical societies' referred to Blue Shield as the "economic arm of the medical profession." The report concludes that some forms of medical participation in control and Blue Shield and other plans may be illegal as violations of the antigrust laws or as unfair conflicts of interest.
