Th Ford sedan had Mopped In front of the Setser home, and Thomas no tteed a man had gotten out of tt Whoa Thomas got his car stopped the man was within 10 or II feet of htm. Cross-Examined On cross lamination Thomas staUd that h . bad known Allen about one year. Allen's- place of business wa a short distance from the Forest Hill. -Motor company where Thomas mad headquarters while In Coneord. Allen had paid a total of 1 1(0 oa the car. H bad used the oar only on Sunday, Thomas denied that Allen bad said th caa was unsatisfactory, and th reason the money was not returned waa because K. L.' Morrow refused to return It. He said Alien had no Ill-will toward him personally, but waa "sore' with Morrow and com pany ana said they war a "crooked bunch." When Thomas stopped near Over caah's th Ford aedan was about SO yard from hla car. Before defend ant stopped his ear he had seen a man ret out of th Ford, but paid no attention to him and did not no tice him again until h was 10 or II feet from his car. The man walked up to the Thomas car on th Uft hand and laid his hand on th car. Thomas did not see what waa in his hands, and he never looked to ae If be had anything. Th de fendant illustrated how th man bad stood beside his car at th time th shots were nred. Than th de fendant drov away rapidly. Been la Ooart Before. The defendant admitted that h had ben In th courts before. He was convicted of bitting a man and fined ill. He had som troubl with a party who atated he was going to shoot Thomas on eight Th man approached Thomas la a threatening manner and Thomas held a run In hi face, b testified Th case was thrown out of court In Spartanburg b had bad ' two fights. On was with a man who slapped him In th face, and th other with a negro who bad hit him. Thomas contradicted part of the stenographic report of th hearing in Charlotte relative to the number of times he had visited th Over- cash home He stated here today that be had been to the horn but on Urn. Deal was also called! balk to the stand, and he corroborated Miss Sloop's statements. - Mra Lowe did not go with them, but urged them to wait for Thomas, he stated on re -direct examination. J. C Goodnight, who was work ing for Mr. Overeash ea October II. testified next He saw Thomas three tlmee that day. h aald. Kannapolts merchant stated that hs talked to Thomas sev eral times on October II. He ea'd he planned to go to Charlotte with Thomas.
