New Game And Fish Law I, Passed By LegtMature For Hertford County Representative Lawrence Say* He Will Submit Reaume of Work in Early Issue New laws affecting the game hunt ing season in Gates, Hertford, Bertie and Northampton counties are con tained in a bill which recently passed the state legislature. Representative Uoyd J- Lawrence has mailed a copy of the law to the HERALD, request ing that it be published. Mr. Lawrence has also advised that he will submit for publication within a few days a Anal analysis of the work done by him during the ses sion of the legislature which closed last Tuesday. The Game laws are as follows: A BILL TO BE ENTITLED AN ACT FOR THE PROTECTION OF GAME AND FISH IN THE COUNTIES OF BERTIE, GATES, HERTFORD AND NORTHAMP TON. The General Assembly of North Car olina do enact: Section 1. That this act shall be known by the short title of "The County and Fish Law." Section 2. DEFINITIONS. That for the purpose of this act the follow ing shall be construed, respectively, to men: ? PERSON. The plaral or the singu lar aa the case demands, including in dividuals, associations, partnerships and corporations unless the context otherwise requires. TAKE. Whenever it is made law ful to "take" birds, game or fish it shall mean the pursuit, hunting, cap ture or kiling of birds or fish in the manner, at the time, and by means specifically permitted. Whenever it is made unlawful to "take" birds, game or fish, the word "take" shall include pursuing, shooting, hunting, killing, capturing, trapping, snaring and netting birds or fish. OPEN SEASON. The time during which birds, game or fish may be law fully taken. Each period of time prescribed as an open season shall be construed to include the first and last days thereof. CLOSE SEASON. The time dur ing which birds, game or fish may not be taken. Sec. S. MANNER OF TAKING GAME DEFINED. Game birds shall be taken only in the day time, be tween sunrise and sunset, with a shot SON. Rabbits may b# taken in any number from October first to March first. Rabbits lawfully taken may be bought and aold during the open sea son. Sec. 7. UPLAND GAME BIRDS; OPEN SEASON; BA<S LIMIT. Qual, commonly ealed bob-white or part ridge and wild turkeys may be taken from November first to the last day gun not larger than No. 10 guage or a rifle, unless otherwise specifically permitted by this act. No person sail take any game bird, by the aid or with the use of any jack-light, or other artificial light, net trap, snare, salt-lick, or poison; nor shall any such jack-light, net, trap, snare, salt-lick, or poison be used or set to take any game birds. A person may take game birds and wild animals during the open season therefor, with or . without the aid of a dog, unless speci fically prohibited by this act Sec. 4. WILD DEER; OPEN SEA* SON; BAG LIMIT. Deer may be taken from October first to January first ?A person may take not to ex ceed five deer in the open season. Sec. S. SQUIRRELS; OPEN SEA SON; BAG LIMIT. Squirrels may be taken from November first to February first A person may take in any one day not to exceed six squir rels. A person may take in any one open season not to exceed six wild turkeys, and in any one day not to exceed twelve qual or bob white, partridge, and ten of other species of upland game birds in the aggregate of all kinds. Sec. 8. MIGRATORY GAME Birds, open season; bag LIMIT; POSSESSION. Migratory game birds may be taken, possessed sold and bought only during such time and in such manner and num bers ^s are or may be prescribed by regulations of the Federal Migratory Bird Treaty Act and Regulations thereunder. Sec. 9. POSSESSION AND SALE OF GAME ANIMALS AND GAME BIRDS. Game animals and game birds lawfully taken may be possessed during the open season therefor, but a person may not have in possession In any one day more than two male deer, two turkeys and one day's limit of other game birds. Sec. 10. certain non-game BIRDS UNPROTECTED. English sparrow, groat horned owl, Cdoper's hawk, sharp-shi ned hawk, crows, Jays, blackbirds and bokaerds and their nests and eggs may be taken, possess ed, bought, sold and transported at any time in any manner, bat such birds may not be killed by the use of poison. Sec. 11. DUTIES OF SHERIFFS AND OTHER PEACE OFFICERS. AH sheriffs, deputy sheriffs, police officers and constables are hereby made ex-officio Deputy Game War dens, and it shall be their duty to aid in the enforcement of this law, but shall serve without compensation except as herein provided. In addi tion to fees to which he may be en titled under the general law of the State any sheriff or other officer shall receive the sum of ten dollars in any case involving a violation of this act in which he secures the evidence upon which the conviction was obtained which shall be assessed against the de fendant and paid by such defendant as a part of the coat in a case of conviction; if no convietion is pro cured, no fee shall be taxed against the county. Sec. 12. That for the purpose of protecting the Ash hereinafter men tioned, during their spawning season no person or persons shall take from any streams in said counties, by use or by means of any wire trap or fyke net, or gill net, except from and in eluding the first day of December to and including the fifteenth day of March, in each and every year, any speckle perch, raccoon, perch, red throats, yellow or other perch, or any ! sun fish and bass of all kinds. Any person violating the provisions of this section shall be guilty of a misde ' meanor, and upon conviction shall be fined not exceeding the sum of fifty dollars, or imprisoned not exceeding thirty days. ^ See. 13. That said game wardens, sheriffs, duty sheriffs, and constables shall be charged with the duties of enforcing the provisions of the pre ceding section, whose compensation shall be made in the same manner as provided in section eleven, of this act, and said compensation ?shall be assessed in all convictions prising under said preceding section in the same amount and manner as provid ed in said section eleven. Sec. 14. PENALTIES. Unlets a different or other penalty or punish ment is herein specifically praaeribed, any person who takes or kills any bird, game or Ash in violation of any of the provisions of this act, or who violates any of the provisions of, or who fall* to perform any duty impos ed by this act, is guilty of a mis demeanor and upon conviction there of shall be lined not leas than ten dollars nor more than fifty dollars or | be imprisoned not more than thirty days. Sec. .15. Tbat this act shall apply only to the Counties of Bertie, Gates, Hertford and Northampton. Sec. 16. That all acts inconsistent with this act are hereby repealed Sec. 17. DATE EFFECTIVE.
