Section 1. lie it er.ucted by the General Assembly of the State of North Caroliua, and it is hereby en acted by the authority of the same, That all war rents issued by a Justice of the Peace iu civil cases, Shall not be returnable within twelve mouths after the execution of the same, before some Justice ot Peace for the countv. . . ,. Sec. 2. Be it further enacted, That the ju.isd.c- j tion of Justices of the Peace shall extend to one , hundred dollars, principal money, on all bond? bills, promissory notes or accounts stated, and shall extend to sixtv dollars principal money, upon ac- j counts for goods, wares and uwrcoandise sum anu delivered or for work and labor done, or for specific articles, and all balances of sixty dollars and under, due on such last mentioned debts or demands, and :..,i.nn rpnJfrfd therein, and on all lor- OB ll I'JUjjiui"- - ' , i feitures and penalties not exceeding one hundred dollars: Provided, That tLis section shall not be constroed to take from the courts the juiisdiction j In cases of less than one hundred doilafs, upon j which writs have been issue! prior to the ratiuca lion of this act. Be it further enacted, That all warrants issued bv a Justice of the Peace, for any debtor demand w ithin his jurisdiction, according to the provisions of the above section : Provided, That said debt or demand is due upon any contract, whether by bond or note or liquidated account, or any parol agreement made or entered into, and due prior to the 1st day of May IfcCo, shall not be re turnable for trial whhin twelve months after the execution of the same, and at the return of the same, if the defendant or defendants shall pay to tne j plaintiff, his ngeut or attorney or to the otlicor ex- ,; 4-cuting the warrant, one tenth of the -principal and j interest, and all costs that may have accrued there- j oo, he, she or they, may have twelve months longer j lo plead, at the end ot which being again notified , of the time and place of trial, if the defendant or . defendants shall pay one fifth of the principal, inte- j rest and costs, he, she, or they shall have twelve ; mouths longer to plead, at the end of which time, if j the defendant cr defendants shall pay one half of j the residue of said claim, he, she, or they sinll have j twelve months longer to plead, at the end of which j time the plaintiff shail have judgment for the re- , ' ... .... Sec 4. Be it further enacted, That on all debts contracted since the first day of May, 1865, and all warrants issuing for the same, shall be returned and tried according to the provisions of the Revised Codp, chapter sixty-two, (02) and the remedy in all such cases shall be the same as in 18C0. Sec 5. Be it further enacted, That all writs in ac tions of debt, covenant, assumpsit or account, issued to Fall Term, 1866, or Spring Term, 1867, of the Superior Court, thall be returnable to Spring Term, 1 BOS, and all of said actions now pending in the Superior Court shall be continued to Spring Term, 1S0S : Provided, That the Sheriff shall not be al lowed in any case to levy execution before the lirst day of January succeeding the rendition of judg ment. Sec G. De it further enacted. That all writs in debt, covenant, assumpsit or account, shall be re- j turnabie to Spring Term of the Superior Court, and i shall be served at hast thirty days (Sundays inclu- j tied) before the return day. It during the return term, the defendant pay to the plaintiff, or into j court for his use, one tenth of the debt or demand j (principal and interest) and all costs to that time, he shall be all wed until next i t rm to plead. At the said Spring Term should the defendant pay to plaintiff, or into court fur his use, one fifth of the residue and costs, he shall be allowed until the suc ceeding Spring Term to plead at the said Spring Term; should the defendant pay to the plaiutill'or into court for his use, one half of the residue, he shall be allowed until the succeeding Spring Term to plead: Provided however, the plaintiff if requireel 6hall file his debt or demand in writing, and if the defendant 6hall make oath that the whole or any part thereof is not justly due, or that he has a coun ter claim, all of which shall be particularly set forth by affidavit, then the defendant shall only nay the instalment required of w hat he admits to be due, and the court shall order a Jury at the same orsub Beejuent Term to try the matters in dispute between the parties, and at the next Spring Term the defen dant shall be allowed to plead only upon the pay ment of one fifth of lh residue of the admitted amount, and whatever the Jury may find him in debted over and above the same: Provided further, that should the defendant fail to pay the first or any subsequent instalment, then, and in that case, the plaintiff shall be entitled to Judgment and execu tion for said instalment : Provided however, any debtor tendering or paying to his creditor on any debt contracted prior to the first ilay of May A. D. 1805, the one tenth of his indebtedness without a Buit having been brought on the same, the said one tenth shall be cnteicd as a credit on the evidences of said indebtedness; thereafter the remainder of'said indebtedness shall not be sued on for twelve months after the payment or tender of said one-tenth. Sec 7. Be it further enacted, That so much of the ordinance of the Convention, passed on the 23d of June 1866, n shall eonie in conflict with this act. together with all other laws coming in conflict with the same, be. and the same are hereby repealed. Sec 8. Be it further enacted. That the time elapsed or elapsing from the twentieth day of May, 1801, until the first, day of January 1870, shall not be counted so as to bar actions, or suits, or to pre sume satisfaction or abandonment of rights.
