That tha subscriptions authori rized in tha 40th of this act, shall be solely for the continuation of the road from Char lotte to a point at or near liutberfordton, and shall be expended for no other purpose whatever ; and if the said one-third amount of the capital stock is Jnot raised, then the said Wilmington and Charlotte. Railroad company sbail be under no obligations to continue said road beyond the towu of Charlotte. Stv. 43. A nil he it further enacted, That any railroad company incorporated by the ileiieral Assembly of this State, shall have 1 avc to make a connection with said Welling ton and Charlotte railroad, and at the point crpoinftof connectiou shall have leave to erect liecessasy buildiugs for receiving and forwarding produce, merchandize and pas souirers, to be transported on uch intersect road or roads. Sko. 2nd. lie it further enacted, That the Capital Stock of the Wiltnintot Char lotte and Rutherford Rail Road Company shall be three millions of dollar, to be rais ed in the manner and for the purposes pre scribed in the above recited act, Sk.o. 3rd. That the said company shall have power and they arc Leivby authoiizcd to commeuce the construction of said Rail Road at Charlotte, and extending West in the direction of Ruth erfordt -n as soon as the requisite amount shall. have been subscribed for that pur pose : Provided, that nothing herein con tained shall be so con-trued as to require said Wilmington, Charlotte and Rutherford Rail Road to expend any money -upon the con.-trnction of the Road West of Charlotte, fi. pt sueh funds as may be subscribed for that purpo-e iu the manner prescribed iu the before recited net.
