THE PROTOCOL BETWEEN FISH AND POLO. New York, " Nov. 29 Noon. A double leaded editorial in the Tirms, of this morning, treats of posco as u foregone conclusion, and praises what it calls the good temper and tuot uf Ad miral Polo and Secretary Fish, iu hav ing effected it. It reads: There can be no impropriety iu mentioning that Admiral Folo has endeavored hy nil honorable meRtia to .bring abont u peaceable solution, without forgetting, for a moment, the, claims of his cum try. . The Herald's dispatch says that Soo retary Fish has no doubt but that the Spanish Government will be able to enforce the order restoring the Vir ginias to the Unjted States. Colonial Minister Solor, who is now in Havana, will personally cee that the orders of the home Government are - promptly carried out. . All the Washington spcceials in the morning papers unite iu asserting that Spain- has conceded to our domands and peace is assurred. i The Tribune's dispatch says : The dispatch deciding the grave question whether there shall bo peace or war between the United States and Spain was received by Mr. Fish to-night and communicated to the President and Cabiuet. It is of the most satisfactory character, .and concedes all the de mands mado by the United States. These demands, ns heretofore stated, areas follows ; First, the release of the officers and crew of the Virginius liv ing ; Second, the return of tho Vir ginius ; Third, tho usual salute to the flag ; and, Fourth, provision for the families of tho slain captives. The only reservation on the part of Spain is with reference to tho firing of the salute. To enable the future investi gations to bo made, tbo date fur this salute' has been fixed at 25th of Dec To provido for tho contingency of Spain not being abls to enforce the promised concession?, the work on the naval constructions is not to bo inter rupted. Tho Times' dispatch, in addition to the above, says that Spain also agrees to bring to trial aud puuislimeut the officers who perpetrated tho horrible butchery.' Madrid, November 29 Noon. The panish Tribunal lias agreed to deliv er to tho United States Government the Steamship Virginius, and nil per sons remaining alive, who ware captur ed with her, leaving the question whether the seizure of th'e vessel was legal, tp bo settled hereafter by a Mixed Tribunal. The question wheth er damages shall be paid to the fami lies and relatives of tho prisoners who woro sho , is also to be 'settled in a sim ilar manner. This decision was not arrived at by tho Government beforo it had crufi dentialiy consulted with tho powers of Etiftrpe rtml was informed by all of them that reparation was duo for the capture of the steasicr and excent ion of the captives. The negotiations between the United States , and Spain, with regard to tho ques tions growing out of tho capture of the Virginius, were brought to a con- elusion to-day, Secretary Fish and Admiral Polo having agreed upon and signed a protocol, which the latter soon after tolegrapued to his Govern- ment. As conflicting statements have ap peared in thfe newspapers regarding the intelligence received last night aud to-day, it.con now be positively stated that tho torms are substantially ns follows : '". 1st. The immediate delivery to 'the United States of the ship Virginius and all the surviving passengers and ' crew. .- ' 2nd. A salute to our flag on the 25th of December next, unless, in the meantime, Spain shall satisfy the United States that tho Amerirnu fj.ig was improperly borne on that vessel j and fuither, that she had no right to tho American nag or American papers. la this event the salute is to be spon taneonsly withdrawn, and Spain is to formolly disclaim any intentional in dignity to the flag in the acts com- " mitted by Spain against the Virginius 8rd. If it shall thus bo shown that the Virginitis had no right to can-y tho American flag and papers, the United States will institute proceedings against tho surviving parties who have violated the laws of tho United States, and Spain guarantees to institute pro ceedings agninspruy of her authorities who urn haveviolated either the law or tho treaty ytipnlations. 1th. Tho words, immediate release, as ap plicable to tho delivery of tho Vir ginius and tho surviving passengers and crew, implies, of course, a reason able time for the execution Is some days must elapse before Havana and Santiago de Cubu can bo reached. The agreement 'is regarded iu official quarters as covering all the points of our original demands, though in a modified form, while it is considered r spectful and Lonornblo to both countries. -The fixing of the 25tU of December as tho time for saluting our flag is to allow the necessary opportu nity to Spain to show that the Vir ginius improperly carried the Ameri can flag and American papers. There is a sensible relief in all quarters that the negotiation has thus peacefully ended.
