People do not nudenttsud how a man like Beterdy Johnson, a lawyer and a statesman and a genllemau of the old school, whose name, during a long Ufa, was nerer tarnished by auy a-o-ciation eiUier with rascals or rascality, could consent to come here as the paid attorney of men who ate seeking to force upon the people of North Carolina the crushing weight of the frauds and corruptions of the Radical Legislature of 1858-'69. ' The questions before the Legislature promise to be of special interest, too. One of these, to wit : the effect of the declaration of the ratification of the oonstituUonal amendment abolish ing : annual , sessions, upon the present aetaion of the Legislature wat referred to t joint select committee of the two Houses. The committee after doe consideration reported that the amendment hat no effect whatever up on the present session, but that it it operAlire-ealy on future sessions of the Legislature. -'The Attorney-Gen era!, Coloael Hargrove, who was pres ent by invitation of ihe committee, at their meeting expressed himself is very decidedly and confidently of the opin ion tbat there it nothing in the sugges tion made by Governor Caldwell that the effect of the amendment would be to put an end to the preeent session, It Is aaid too, that Mr. Reverdy John acq has expressed the opinion that its operation will be only prospective. So it seem tbat OovernorCaldwsll stands "alone in hit glory." but this is not lurprifttag, for at a prominent Radical, himself a lawyer and laughing at the suggestion, aaid if it be possible for a wrong notion to exitt npon a question of law, Governor Caldwell will be sure to find it. But if the Governor is not a lawyer, he it at least "honest" they say. Cer tiuly heis very anxious to have the State debt settled, and to make a Dem ooratie Legislature levy a tax upon our people to pay the interest on the "set tlement", but he forgets that it is only Radical Legislatures like -that of 18C8-'69, when he wat President of the Senate, that are so profustt in leryiag taxea on the people, Hs forgets that now the Legislature represent the tax-payers; that theu it represented only the non-tax-payera. Now they are careful of money, then they squan dered ii Aud this brings me to another ques tion that wat referred to the Joint Committee of both Houses, to-wit the settlement of the public debt. If I am correctly informed the determi nation of that Committee is to reoom mend no action nntil the decision in the injunction cases now' pending shall have been rendered. The resolutions of Mr. McNutx, of Robeson, upon the subject of the Special Tax Bonds, it it understood, meet the' views -of the Committee, and the result of their de liberations and the substance of the action of tlie Legislature will probably be to declare in some shspe or other that North Carolina does not regard the Special Tsx Bonds as auy port of her debt, aud her fixed determination not to pny thrru. The old debt will probably be permitted to rcmniu in ila present couditiou. The pressure of the panic is too great (o talk about im posing any taxes on the people that can possibly be avoided. Nor is it expedi ent to make any dispoeiliou of the old dobt until it is definitely ascertained what action the Federal Courts will take in reference to (be new debt, so called. But the great question of the week promises to be the Rail road consolidation bill. lu the Senate tha bill was set down for discussion at half past twelve o'clock on Tuesday. This bil or rather the object it pro poses to accomplish, ia truly an im portant one. It will doubtless be ad mitted on all sides that tha great ob ject of all schemes for works of intern al improvement in North Carolina ahould be to effect a passage through the mountains in the Western part of the State, thereby giving the seaports of North CaroUna an opportunity to compete with those of other' States on the Atlantio coast for the freights of tha great valley of the Mississippi aud tha Pacific slope. The present scheme proposes to accomplish this purpose by consolidating the Atlantic, the North Carolina, and the Western roads and then by tale of mortgage bonds to raise the money necessary to effect tha passage through the mountains. The Western Extension it insolvent, the Atlantio Bead also it insolvent The capital of the new conoern it then to be furnished by tha North Carolina Road. The State owns two-thirds of the atock in that road. , If the general opinion at to the effect of connecting our North CaroUna roads with those of the Great West by a passage through the mountaini be correct the State can well afford to sacrifice its interest in tha North Carolina road to effect that passage. Butnodiscriminationsought to be made against any section of the Etate in carrying out the scheme for which the common property it to be acrifleed. There have been enough Hoi- den's aud enough Sweieon'a aud enough LittlcfielJ s in North Caxoliua. j There must be a certainty that the toad will be built or the Bute's inter est in the North Carolina road ought not to be mortgaged. It cannot be repeated too often tbat there ought to be a guarantee for the completion of the road, and securitjrfof the proper application of the money provided for ita construction. It may be well doubteJ, however, whether Governor Caldwell it not much mistaken in the amount he con- aiders sufficient to curry put the enter prise. It will doubtless turn out in this as in other cases, that the esti mates fall far abort of the actual cost of railroed building. I learn that our Western friends are keenly alive to the importance of securing proper guarantees for the completion of the road and the proper application of the mouey raised for ita construction, and will seek to obtain them by amend ments if the bill now pending does not already contain them. And in this their wishes ought to be respected. They have a right to demand guaran tees, and if ever a people knew from tad experience the importance of hav ing them, the people of the mountains know it. Let the bill be guarded in every way possible. The Legislature of North Carolina owes this much at least to the people of the West, that they shall not be cheated out of the best chance to obtain the transportation facilities they so much need, by a want of proper guarantees. - But let tha Legislature do what it will, tha consolidation oannot be ef fected without tha consent of certain other parties, to wit : the creditors of the North Carolina Road. There are two olasaet of these creditors, one class known at " income bond " holders to the amount of $360,000; the iucome of the road being pledged to their pay ment. The other oloss is known ss the "conatmotion bond" holders to the amount of (2,700,000, whose bonds constitute a lien on the road. At the instance of some of these parties au injunction has already been issued to prevent the consolidation. These peo ple must be satisfied in some way Ike fore the much talked of consolidation can be effected, as the courts will not allow any action to be taken that will impair the rights of creditors or the vslue of the property npon which they have a lien for the payment of their debt. Everybody is in favor of the object of the bill, and is willing to make sac rifices to attain that object, and it will doubtless pass after having the proper safeguards thrown around it. The bill will not pass, however, it is thought, so long as its provisions per mit another Railroad President to play the part of Swepson and Littlefield. What arrangements can be made with the creditors remain! to be seen. It is said that some of them are not averse to the enterprise, believing that "rou solidation" will greatly duhance ihe valuc of the property upou which they have a lieu for their debt.
