Dr. J. G- Rives was introduced
by the State as an expert regarding
the mode of the woman's death. He
gave it as his uuqualilied opinion
that the deceased could not have
come to her by being struck or riiu
over by the train on accouut of the
very small quantity of blood to -Ik
seen near the track and slout the
body only enough blood being
there to have issued from the chest
alter death when struck by the
train. ; He said he wassatislied the
woman wsis not alive wl(en the train
struck her. I !
There was no evidence ottered by
the defence. It is probable thslt
Jerry himself would have taken the
stand as a wituess in his own lie
half, but for the fact that the Solic
itor (ever wide awake in such emer
gencies) had caused gentlemen in
Wayue county to lie summoned lis
witnesses as to the character" of
Jerry, and they were promptly on;
hanil. But, as Jerry w as not ex-1
amined, these iinieiiehing witnesses
could not lie introduced. -'".

The prisoner's counsel then mov
ed for a new trial which was refus-'
ed. The prisoner when asked what
lie had to say why judgment of death
should not be pronounced against,
him replied that he hadn't had a fail
trial ; that the jnry hadn't given
liini justice, and tliat he was an in
nocent man. j
His Honor then sentenced him to
lie hanged on Friday the 22d day of
Septeinliernext. From this judg
ment the prisoner sippealed to the
Suoreme Court.
