Kissing.
A ciirioiiH case of osculation is
reported from at-ioss the Atlantic.
Some time ago a Mr. Finch, who
wiuin the iewelrv business in
Xewburu, CiiitcuV States, sold to a
younj? larty named Miss Waters
what was described as a beautiful
set of real jet, the bargain Wins
that he was to receive .. payment
thereof one hundred kisses, to le
paid at the rate of one kiss daily.
Mr. Finch was to call at the lady's
house every morning, Sundays ex
cepted, to receive his daily kiss,
which Miss Waters undertook and
promised to duly deliver to liim.j
For thirty consecutive days, huu- :
days excepted, Mr. Finch punctu j
ally called upon Miss aters, and
duly received the stimulated salu
tation. On the thirty-first day,
however, Mr. Finch inadea form
al complaint that Miss Waters
was not fulfilling her contract, in
asmuch as sheinsisted upon per
mitting him to kiss her cheek only.
He maintained that this did not
constitute ii legal kiss, and de
manded that he hould be allowed to
put his left arm around her waist j
, and kiss her in the highest style of j
the art. To this, however a hrin
refusal was returned-. The lady
offered Mi. Finch the choice of
cheeks, but insisted that the con
tract would not War the construe
tion he put upon it. Thereupon
Mr. Finch, in great indignation
ltrourhtaii action for breach of
contract against the lady.
This action raised several new,;
and interesting questions, among j
the most important' of which
was.what constituted, in the eye of
the law, a kiss? The plaintiff set
up the further plea that there was
a difli-ivuce between active andpas- j
sive kisses; that Miss Waters had j
promised to give him a certain j
iiiimlicr of kisses not (merely to I
allow him to take them and that j
giving kisses was an act which re- j
quired the use of lips. The case j
was the subject of considerable I
controversy in the press and else-
where;mit. the writer, nnfortuiiatly j
has never' been able to discover !
the result of the legal proceedings
which were constituted, and has j
concluded that a piomiseof some
sort must, as was at one time, ex-
peirted, have been brought about, i
