E iward Couiijiaod, of Halifax County, sued tbe Wi!ti.iwgton & Weldrni lliil road for daniagcs, tho deceased bcirg ran over and killed by a train on that rrnd some eighteen months ago. lie was quite deaf, and did not hrar the train. The case has just been tried ih Northampton county, and the jury has warded the pluiUiffs 000 damages. The worth of such a man as Mr. Cooiglaod to his family and to the State canoot be .es timated by dollars and cents, but even if it could there arc questions of equity arisiujr which are entitled to doevnt respect and which should be adjusted in tbe minds of the law maker, court and jury, beforo a defendant is allowed to be mulcted." Why sucb comments should follow this verdict we cannot sty, unless it be that the editors write about matters of which they know nothing, or are misled by tbe frieadi of the lliilroad, who leek to create a false sentiment in their favor but whatovor tho cause, we think tbe press should leave the case with the courts, whoso duty it is to de cide it ; and who, we may safely as sume, will treat it with as "decent res pect" as it is entitled to. For the in formation of our contemporaries, we would lay that the casn was tried by au able Judge, on impartial jury, and by eminent c 'tinsel. To those, even, who were nit at all interested in the cause, lbs testimony showed gross and wanton almost cruel ifglipcco ou tbe part of the C impany and that by tbe most ordinary prudence, nnd care on ill p rt, the fearful disaster could Live been prevented. They shall, with respect to this work, constitute aud be suled the "Hiard of Supenlsors of Public lUads" ef such township. They nre hereby in corporated, and the above shall be their corporate name. Sec. 2. The said board of supervisors shall meet at some place in their respec tive towriihios. to be nureed upon by themselves, or in the absence of such agreement, to bo named by their chair man, on the first Monday of February, May, August aud November, for. the purpi'se ol consulting on tbe subject ol tho condition of the roads in their town ship. Se:. 3. The said board of supervisors shall annually, at the meeting in May, divide the roads of their townships into section?, nnd appoint overseers for said sections nt said roceliugs. They shall at the same time allot the bunds to said overseers and shall also designate the boundaries or points to nbich each resident shull be liable to work on said section, and shall, within five days after suc'i meeting, certify to each overseer written notice of his appoint ment, with a list of the hands assigned to his section : Provided, that the board of supervisors may ut ooy time alter tho teetinus or allotment, hut sha!l give nutico thereof to the overseer. 'Hie overseer may resign after the expiration of twelve months, provided Im road shall be in good repair and the hoard of supervisors shall so fi id ; and any over seer so resigning, and whosj resigna tion has been accepted by tho board, shall not without his consent bo again appointed overseer until after tho ex piration of two years from tho date of his resignation. That when a public road shall be a dividing lino between townships tho board of commissioners of the county shall determine as to how said road shall be divided, ni'.h notice as to the working of said road. Sec. . All able bodied male per- sons between the ages of eighteen years and forty-five years shall be req aired under provisions of tins act to work nn the public roads, except tho members of the biard of tuuervisors of .public roads, net less than i5 duys in each uud every year. bee. 5. Fiery person liable to work on the road who has been so summoned shall appear at the time and place named, and with the implement directed, and shall work on the road under the direction of tbe overseer until discharged by him : Provided, that no hard shall be required to work for a less time loan seven hours oor for a luugcr time thaa ten hurs in any one day. The board ol supervisors shall annuuly make report to the first term of the superior court of their cour.ty nftcr the first Monday in August ol . the condition of the roadi of their township. gid if the meetings provided for in this act have been held for said board, and the judge holding such term ol the superior court shall after his charge to the grand jury and before they shall retire to their room call poa the cleik of the court for such rrport", and they shall then and there be delivered to tho foreman of the grand jury; and if any board of supervi sors shall fail to make said report or tu discharge any other duty impo-ed by this act, they shall be guilty of a misde meanor and on convicuou thereof shall be fined or impris oued, or both, in the discretion of the court, and the indict avnts miy be cither against the board of supervisors, or against the individuals compising it as justices ol the peace. Sic. 11. The several superior court clerks and the register of deeds in the slate shall within twenty days after the passage of this oct post a cpy thereof in some conspicious place in their respec tive offices, aud t carry out this pro vision the secretary of state, immediate ly upon the ratification of this act, shall cause to hu published in convenient form for this purpose a sufficient number of copies of this act, and be shall mail one copy to each and every superior court clerk nnd register of deeds ia the stale : Provided that tho provisions of this net shall rot apply to the counties of Alleghany, Ashe, Alexander, Watau ga and Mecklenburg. See. 1 2. All laws and clauses of laws iu conflict with the provisions of this act are hereby repealed. Sec. 13. This act shall be in force from and nftr its ratification.
