Garrett, a noticeable feature be ing a large heart made of evergreens and suspended just back of the pulpit, while potted plants and choice flowers were profusely arranged about the chancel. At the hour appointed and just as the bridal party entered the vestibule, Mrs. W. T. Shaw sang with exquisite taste, "Believe." A seaboard air line yard master 18 ATTACKED BY A NEGRO AND SII03T8 IN SELF DEFENSE. James Henry Banks, colored, a yurd band, was shot and instantly killed here Monday morning about 9 o'clock by night yard master, C. A. Hudson, of tbe Seaboard Air Line. The negro, who was large and strong as a giant, attacked Mr. Hudson at the railroad crossing near the round house, had him in the collar and down upon the embankment. Mr. Hud son is a small man, and realizing that there was no escape and fearing that he would be killed or receive great bodily harm, he fired in self defense He did not want to kill the negro and fired about the shoulder it first. Drewry, and Lucius Green. Tbe jury viewed the body about ten o'clock and then ad- ourned over until 7 p. m. When the case camo up it night the ball was well crowded. Mr. David Bell, of the firm of Day aod Bell, and Mr. T. C.Harrison, appeared for Mr. Hudson. Several witnesses were examined. Mr. W.W. Williams, chief of the wrecking crew, however, was the only eye witness and his testimony was clear and given without prejudice. Ho said: "I was on the engine when Mr. Hudson came along and culled me. We were talking when Banks came by and passed on, walking i car length from us. He then turned around and came back and wanted to know what Hudson was telling me. I told him Mr. Hudson Baid that be (Banks) bad cursed him. Banks turned to Hudson and made a remark. Hud son said 'that's not so.' Baoks said, 'if vou say that's not so, you are i G d d n stinking liar,' and grabbed Hudson in the collar and shoved him across tbe track and up against tbe bank. I beard the pistol fire, saw that Banks had Hud son iu a tight place and after Hudson bad filed four or five times, I saw Baoks run off, then wheel around with a look is if he intended to rush upon Hudson gain, but he fell upon the track." Mr. Williams being questioned by Attorney Bell, sjid that Baoks could easily have handled two or three men like Hudson. That Hudsoo ceased firing the minute Batiks released bim and did nut fire an other shot. Mr. Gort and Mr. W. D. Stainback were next examined, they did not Bee the shooting but told of the difficulty leading up to the killing of Banks. Bryant Manly, colored, was i witness but he did not know anything about it he only heard the report of the pistol. After argument by Messrs. Bell and Harrison, the jury took the case aud after deliberating for a short time re turned the following verdict : "We, the jury, fiod that James Henry Banks came to his death, while making an aggressive assault and attack upon one Carter A. Hudson, by i pistol shot from tho hands of said Carter A. Hudson, ac ting in self defense; and we further find that it was justifiable homicide, and that the said Hudsoo is guilty of no crime, be used no more force than was neces sary to defend himself against said unlaw ful assault and attack hy the deceased. The following ap peared in the editorial columns of the NeWBand Observer, dated February 19, and will be read with interest by Mr. Summerell's many friends in Halifax oounty : Io its issue of Wednesday, July 19, 1899, this piper made charges of cruelty to the convicts under him against Mr. E. L. Summerell, of Northampton, who was then supervisor of the Northamp ton State farm. For these charges Mr. Summerell brought Buit against the editor of this paper and the News and Observer Pub lishing Company. This suit has now been compromised and settled and we do now withdraw all charges heretofore made io the columns of the News and Observer against Mr. Summerell and re gret their publication. These charges, when made, were based upon reports which then appeared to be correct, but which we are now advistd by leadiog and prominent gentlemen of Northampton county were incorrect and unjust to Mr. Summerell. .
