HOUSE OF REPRESENTATIVES. ; Mr Wilson, of Burke, for himself and other members of the House filled a protest against the action of the House upon a part of the bill for the speedy completion of the Western North Carolina Railroad iri striking out the interest of the private stockholders;'! -j i - . . We the undersigned members of the General Assembly, beg leave to file our protest against- Jthe action of this body - upon the bill for the completion of the Western N. C.j Railroad by which the private stockholders were deprived of all .their interest in tlje same, for the follow ing reasons, to-wjto : Whereas, We are Informed and believe that a suit was brought in the Circuit Court of the United States by one Hiram Sibley and others' against the Western N. C. Railroad to foreclose a mortgage executed to said plaintiff,which foreclosure was resisted by the private stockholders on the ground that the execution of said mortgage was illegal land unauthorized.- And pending said litigation a bill passed the General AssembTv of Norlh Carolina providing for the purchase of said road by the State,and also providing that the private stockhold ers, when so purchased, should be entitled 'to one-fourth of tlio stock in lieu of the one-third then (!wncd by them. And Where as, the pjriyate stockholders, as the undersigned are informed and believe, relyingi upon the j provisions of the bill aforesaid, anld the faithful perform ance ofjthe promise therein contained, im mediately withdraw their opposition to the relief proposed in said suit and allow ed a decree of foreclosure and sale of the franchises and property of said road to be entered1 and whereas the undersigned are informed and beliero that these facts, in addition to the moral obligation, imposed an implied, if riot kn express contract on the par; of the ( State to faithfully carry out such obligation and contract; and whereas, Ihe action of the House of Rep resentatives, in declaring that said private stockholders are not entitled to said stock, is in direct violation of said obligation and contract. Now therefore, tho undersigned most respectfully protest against such action as a violation of j the plighted faith of the State, derogatory to her honor, and unjust to many of her citizens. Dr. Richard II. Lewis, a native of this State, but at present a resident of Savan nah, Ga., was united in marriage to Miss Nellie V. Battle, at the residence of her father, Hon. Kemp P. It occasioned a great deal of commotiou iu the village, which, it was feared, at one time, would be almost en tirely consumed.
