Jack Davis, colored, who, at thr lal teiiu of Brunswick Superior Court was sentenced to be hanged on the 1 1th day of Jul , uex , for the murder oi McDutfy, mtdfra desp rate attempt this morniug to escape , frm the ja.il at Smithvil e iu which he is coufiued and was so far sue cessful as to get out, but was soon recap tured when about half a mile from the yilage. It. seems th.at tie jailor, Mr. J 4' D. Davis, had gone into the jail and had closed the lower door after him while he went up stairs Jack, taking advantage of a moment when the jailor was attending to some of his duties jn the cell jumped out and closed the duor, thus locking the jailor in Mr. Davis, the jailor, then shouted and told bis wife not to open the other door, but she misunderstood him and unlocked it when Jack rushed past her and made for the woods. In a momeut or two Mr. Davis was also at liberty and gave such hot chase that Jack was soon overtaken. Finding himself about to be recaptured, Jack seized a big feuce rail aud showed fight, but Mr. Davis had also prepared himself with the same kind of weapon and succeeding in getting in the first blow, knockiug the prisoner down, and caught hi n by the throat and choked him into sibmission when he was secured and brought backto his old quarters, where he will probably remain until he is led out to pay the penalty of a violated law. Very much praise is due to Mr. Davis for his prompt and energetio action in the matter. The prisoner is described as a d jsper te character, and without a doubt had the jailor failed in striking the first blow effectually, he would have been killed. . A ppletions' Journal. Wm S Devane, and in order to better organize the meeting, moved that Col. W. A Al'en be called to the chair. Upon taking the chair Coi. Allen made a few appropriate andffeeling remarks. Mr. O. H. Ailed then moved that brethren Jno. D. Stanford and J. T. Bland be requested to act as Secretaries. Mr. E. W. Kerr moved that the Chair man appoint a committee of five to draw up and report suitable resolutions. The Chairman appcinted brethren W Kerr, J. L. Stewart, Swift Gallow E way U. t Allen and A. C.Ricaud. After retiiing for a short time the com mittee returned and through their Chair man reported the following: Whereas, in the Providence of an All Wise God death has removed from among us our highly esteemed friend and brother, Wm S. Devane. Therefore resolved: I. That in his death the legal pro fession has lost one of its most honored, ablest, and most faithful members, society one of its purest and brightest ornameuts, his country a tried and true patriot and one of her most worthy citi zens, and his family, a most affectionate and devoted husband and father. II. That as we loved and honored him while he lived, so in death we will ? herish his memory, emulate his virtues and com mend his high and sterling qualities. III. That we extend to nia bereaved family our heartfelt sympathy aud con dolence iu their irreparable loss. IV. That we request Ilis Honor A. S. Seymour, the Judge presiding in this Court, to direct that these resolutions be spread upou the minutes of the Court and that the Secretaries send a copy of tne same to the family of the deceased and to the Wilmington Journal, &tar and Review and to the Goidsboro 'Messenger aud Mail with request to publish the same. Pending the motion to adopt many kind aud appropriate remarks were made by brethren Ricaud, Galloway, Stanford, and Stallings. All agreed in speaking of him as possessing aH intellect of high r der, mysteriously blending greatness of mind with magnaminity of soul, tbu constituting a useful and true man and faithful friend. But it was not alone in the quiet ef his profession that his talents shone with resplendent lustre When the tocsin of grim-visaged war was eound jd, he was no sluggard, but like a gal lant soldier he buckled on his armor and bravely met his country's foes in the front rauk. Indeed, in every relation of life he seems to have been a model and a pattern-kind, genial, faithful, talented, a true man. The resolutions rerc unanimously adopted by the members rising from their seats, after which the meeting Sdjourned. J. D. Stanfobd, 1 J. T. Bland, Secretaries.
