' Vod Glahn vs. DeKosset et al.; from Brunswick. Affirmed. The Commercial Bank of Wilmington; was incorporated in January, 146, and expired by limitation of its charter in December, 1871. The charter contained a clause making the stockholders individu ally liable for. the debts of the Bank, in case of its insolvency, to the ex eat of double the amount of stock held by each. The plaintiff iu 1875 (and within a year from the "rndfrmenta renr ered awftinst from him wn m w o . o in unsuccessful suits, in his behalf, against separate stock- holders (see Von Glahn vs Harris, in u. ana von uiatn vs Latim r. 76 NO,) brought this action in behalf of htmselt and all other creditors, ike, against the defendant stockholders under the said personal liability clause of the char ter The defendants pleaded the expira tion of the charter, statute of limitations, &c. From the judgment rendered against him, the plaintiff appealed. Held: Until the Statute (Rev Code- chapter 26.) was passed.! a defunct cor poration coald ut law neither be sued nor recover debts due it, but m wuw propriate is resources and means to the discharge of its obligations, the Courts ot Equity interfered and gathered up the asses of the corporation, and through a receiver distributed them among the creditors.
