Heretofore it has been the law in North Carolina that burglary, simple or compound, was punishable only by deaths The amended law grades the crime of burglarly into first and; second dej gree. If the. crime, be committed in a dwelling house or in a room used as a sleeping apartment in any building and any person is in the actual occupation of any part of said dwelling house or sleeping apartments at the time of the com iaisipn of said ecime, it shall be burglary ia tke Irst degree.
