It is a bailable offense, however, let who will say to the contrary. Judge Maares did not like, we pre sume, to go beyond the verdict ot the jury, especially as the case would be tried in his court, but all the same we think-that Koch is un justly and improperly restrained of his liberty. Rainsden's injuries were the result of a street .fight, partici pated in by. both parties and in which no deadly weapons were used and it is'likely that his death was as much the result of his own careless ness and imprudence and bad habits as it was oi me i lujunco wo .. The" Birmingham Age .Herald pub lishes a very interesting description of an organ recently presented to the Judson Institute by that liberal- minded gentleman, Mr. Geo. C. Kel. ley, formerly ot this city, as a tn: bute to the. memory of hfs wife, who was not long ago removed from earth to higher and more beautiful and more 'enduring scenes than fhp. We conv from our cotem- porary the following report: An interesting event at Marion on last Saturday was the : opening of the new pipe organ at: the Judson Institute an event made possible by the munificence of Mr. George C. Kelle'y, of Birmingham, Ala., who donated the handsome instrument to the institution as a tribute to the memory of his wife, the-late Mrs. Isolino Bates Kelley, she having been a graduate from the . institute. Prof. Eugene L. Merrlraan, of Mont gomerv, gave an impromptu recital on the'organ and creditably demon strated its capacity for grand and varied effects in all the lights and shades of tone color. ' The instrument is not only excel lent in iU aiuslcal quaiities, but is pleasing to the eye from the artistic blending of form and color in fts design. It most happily combines dignity and grace of form witha charming harmony of color.
