arrest. He refused to be arrested
unless on a warrant and when the
oflicer raised his club in an attempt
to strike him the citizen seized nim

who had come up caught the club
and prevented the -blow. The' two
were tl.en'separated and the parties
went up to the City Hall and sub
mitted to arrest.
Mr. Marsden Bellamy appeared

was not authorized to make the ar
rest and discharged the. defendant.

continued until Monday.

The powers 'and duties of a police
man should be clearly defined. The
interest at present hangs upon the
question as to whether a policeman
can exercise the right ot making an
arrest for a violation of the peace
which does not come under his own
immediate observation, at the sim
ple request of another party and
without a warrant. If he can, ins
powers exceed those of a magistrate
for no justice of the peace will issue
a warrant upon mere hearsay and
unless an afildavit is made as to the
offense. Indeed, the grand jury
caunot do this.

It is reported tnat . there was a
very disastrous explosion of powder
at Jacksonville on Christmas Day.
Some one got four pounds of powder
with which to fire a salute iu an old
cannon there and while in a house
with the paper bag containing the
powder in his hand a spark from a
cigar he was smoking got into the
powder and it exploded, burning
the man and too ladies teanuiiy.
One of the latter, it is said, was
dreadfullv burned about the chest.
We could get no further particulars
nor could we learn the names of the
parties. 1
