Where there are two oo-ohlio-nr a single bond on which the presume- hnn rf vn a 1 - w pajuifcui, uas aneen, sucn pre samption cannot be rebutted so as to charge one of the obligors by the naked admission of the other that. the bond had not been paid, made in me aDsence or tne obligor sought to be charged. Such admissions with regard to single bonds -are held to be within the scope of section 22, chap ter 65, Revised Code, as such bonds are declared to be, along with prom isery notes, on a footing with inland bills of exchange, and are treated as mere promisory notes under seal. irearsall vs. Houston, 3 Jones, 346, approved. x A judgment, taken by default against one co-obligor can have no greater effect than an admission to charge the other obligor. Green vs. Griffin. An 'interlocutory order or restraint had been made from which Griffin appealed, aud then disregarding it, he was fined lor contempt, and from this he also appealed. On this last appeal the Supreme Court af firmed the judgment, after which judgment of the Supreme Court, Griffin applied to the Superior Court to modify or remit the fine which the jede declined to do for the want of power, and Griffin again appealed. i ne present appeal thus raises the question of the legal power of a sub sequent court, after an' affirmance of the judgment fromT which the first appeal was ' taken to modify or re move the imposed penalty. Held: l bat without deciding? how far a succeeding judge may modify the terms of the order in conducting the cause, yet after an appeal he has no power to do so. - OCR STATE CONTEMPORARIES. The people of Eastern Carolina have about made up their minds to have some part m the general development of this Stare. For ten years and more the whole power of the State has been directed toward developing Central and Western North Car olina, and when the East has remonstrated wa save been told that we would be rele gated to negro rule unless we quietly sub mitted to the discriminations We have borne these things about long enough. We appreciate the aid of the West in political matters ; but the obligation has been con siderably lessened by their repeated- refer- euce to it, ana by the material capital which they have made out of it. Qoldiboro Argus. We do not propose in what has been said to read anybody out of the Democratic ranks ourselves, but if professed Democrats prefer to amiiate with the Republican party in its protection crusade against the people and their paramount interests, that is their own fault simply, and perhaps our mis fortune. They thereby read themselves out, of their own free will and accord, so far at least as this radical measure of pro tection is concerned. For just as sure as certainty itself, the Republican doctrine of "protection" to certain favored interests. at the expense of all other interests in the country, is not Democratic doctrine, and cannot be, in the very nature of things, without rendering the term democracy it self a misnomer a palpsble contradiction is terms. Jieidsmle Times. The Wilmington Stab, the ablest and soundest paper in the State, is very zealous ly in favor of educating tne people. Bo is the Democrat. The Stab urges increased school facilities and increased school terms. Both we ought to have, or we ought to stop the schools altogether.' But the Stab is too farsighted, level-headed and honest hearted to favor increased taxation for school purposes; Now we agree with our esteemed contemporary. We would have educated every child in the State, if it can be done without increasing taxation. Asd we admit there are scoun drels and dishonest property holdere. and exempted property in the State enough to raise several hundred thousand dollars taxes, if they could be reached and the ex empted propsity could be placed upon the tax list. But the serious question is how csn you reach these dishonest people and jb like this exempted property subject to taxation ? Dishonesty shields one class, and unwise and hasty legislation by the gtitc and Federal Government shields the otLer class. Scotland Neck Democrat. . JPERSONAZ,.
