PAGE SIX BRDMMITT GIVES INTERPRETATION Says School Bill Does Not Limit Teachers or Pay in Special Tax Districts RALEIGH, April B.—ln the first opinion of an official nature on the 1929 school act, passed by the re cent legislature .Attorney General Dennis Brummitt held' that the act did not place a limitation on teach er’s salaries or additional teachers in special tax districts or extended term schools as it did in the six months’ school term. His interpretation of sections of the bill was given in a letter sent today to Dr. A. T. Allen in which he answered specific questions asked "him by th<T state superintendent of public* instruction to aid county su perintendents iif *h£ preparation of the May budgets. • _ Attorney General Brummitt dis cussed the act in executive session with the state equalization board but today's statement was his first extended public one. The school act was deprecated by the state teacnerS association at its session here last month and has been widely dis cussed. Dr. Allen told the state as sociation that he was unable to un derstand the application of certain sections. ~ ~ •••“’* The attorney general said that ‘fit may be thought” that the construc tion of the bill would limit the num ber of teachers in the special tax district as provided in the county budget for the six months school term but ‘‘l have reached the con clusion that this construction of the act was not intended by the general assembly.” Taxes for Salaries In explaining this statement he ; said that the special taxes were • voted not simply for the employment of teachers., for the extended term, but also to supplement salaries and employ additional teachers for the whole term. “All courts hold that nothing is more convincing in interpretation of a statute than uniform administra tive practice for a series of year, ’ he declared. “These special taxes wPre intended to be used not only to provide the particular districts with an extended term but to increase the efficiency of the schools bv providing addi tional teachers. As a consequence, many of the districts now have teach ers of music, of home economics, of agriculture and of physical educa tion, one or more of whom in many cases are paid for the whole term out of the special tax funds. Further on he said, “these taxes have been voted by the people of the respective districts. If they so desire, they may vote them off with the exception of such as may be necessary to pay the principal and interest on any indebtedness. The interpretation of the act in this respect, the attorney general said, hinged around section 13, which is as follows: “That all the provisions of this act, including the determination of the number of pupils per teacher in elementary and high schools and in cluding the salary schedule of teach ers in the six months’ school term shall be applicable, as nearly as may be, to any additional school term beyond the six months’ term which may be provided and maintained by the several counties of the State, or by any special tax districts in any counties.” The explanation said “a limitation upon their (special tax districts) right to levy the taxes, voted upon themselves by the citizenship of' the districts should not be assumed by implication or inference. Surely, if the general assembly intended to limit the right of the local com munities to levy these taxes for these purposes it would have used apt language and positive expression for that purpose. It has not done so.” Sets Up Standards H° said, however, “one of the most significant things which the act has done is to set up standards for school administration and school sup port. School officials should make every reasonale report to conduct their schools in accordance with these standards. This obligation rests upon those of the districts as well as upon those of the county.” “The necessary tax rate to be re ouested and to he levied is of course determined by section 30 of the act which sets out the method for dis tribution of the $1,250,000 to these districts. There must he a reduc tion in proportion to the amount re ceived by the district from this tax reduction fund.” In discussing other features of the ; act, the attorney general said that j increments provided in the salary j scale for experience had been al- j lowed in the budget, and that if a j county board of education desired to pay the county superintendent a sal ary greater than that specified in the subject, the salary should be placed in the budget and also in any special tax levy made by the com missioners under section 34. In case of dispute between the board of education and the county commissioners, the clerk of court would arbitrate the question, the state official said. He stated that the county hom’d of education should file with the board of county commissioners a copy of the May budget by the first Monday in June and that the county board of education should await the approval by the commissioners with in 30 days before making commit ments against the budget. Concluding his opinion Attorney Ganeral Brummitt said, “I think that these officials can safely proceed with the preparation with such budgets in accordance with the views herein expressed. If and when the state bonrd of enualization decides io exercise the discretionary powers conferred it, a new condition will be created.
