TAX TIP (Salespersons’ Gift Expenses) Question: Each year at Christmas I give my customers ballpoint pens with my name printed on them. The pens cost me a total of $100. I am a car salesman and am paid on a commission basis. Can I deduct the cost of the pens if I do not itemize on my income tax return? Answer: Sorry. Since a car salesman does not qualify as an "outside salesperson” (one who does his or her selling away from the employer’s place of busi ness). your entertainment and income-producing expenses are not allowed as adjustments to income. The cost of the pens, if otherwise qualified, is deductible as a miscellaneous expense if you itemize. — Provided as a Public Service of H&R Block, The Income Tax People. A woman died leaving a typewritten will in which several provisions were lined out with a pen and ink. There was no evidence as to who made the pen marks, although the will was found among the papers and books of the woman who made the will. Was the will revoked as to the lined-out portions? The North Carolina court said no. A written will, or any part of it, may be revoked by being burned, torn, canceled, obliterated or destroyed with the intent and for the purpose of revoking it. This must be done by the person making the will or by another person in his presence and by his direction. The court said that even assuming that the woman made the ink marks her self still there was no evidence that she made the marks with the intent to revoke. A great deal of care is required in the effective revocation of a will.
