In Routine Arrest

City police are investigating a local man's complaint

-Lt. E.L. Yokley, commander of the narcotics squad, said
he plans to interview eyewitnesses to the arrest of
Theodore Hardy of 629 W. 24Va St. to determine what
actually happened. "At this point, I don't really know
what happened," Tokely ?Hd-^Fuesday, several-hours
after Hardy's arrest at 1:30 p.m. Hardy was also
charged with resisting arrest and with driving under the
intiuence.
In a Chronicle interview Tuesday afternoon, Hardy said
he had pulled up to his mother's home at 509 W. 23rd St.
and was in^the yard when an-unmarked police^ai^parked
behind his car. he said the officers called him to their
car. when he asked who they were, they identified
themselves as police officers, ?

perform tests of his sobriety and then frisked. Soon
afterward, he said, the arresting officers through him
against a police car.
"They told me not to move," said Hardy. "One put a
pistol to my head; one had a pistol in my side." Hardy
said the gun pointed at his head was cocked, and the
officer holding it told him, "I want to shoot it anyway."
Four persons, two of them relatives of Hardy, agreed
with Hardy's account that two officers held guns on
Hardy. Pearl Hardy, his sister, of 2322 N. Cherry St.,
Apt, B, and Joya Hardy, his niece, of 607 W. 23rd St.
said they came out of 509 W. 23rd to find the officers
making Hardy perform drunkeness tests such as picking
up a penny and holding one leg in the air. They said the
officers, without provocation, seized him and drew their

Selena Hulind, address unknown, said she came from a
nearby apartment complex to watch the incident. "They
had pulled him up against the car and Cicero Jones of
1406 Underwood said he watched Hardy drive up to the
house from the nearby corner of 23rd and North Cherry
Sts. "Then I saw the police come around the corner
behind him. The next time I looked up, they (other
onlookers) said, 'They've pulled a gun on him'. I went

There was no struggle from him, but they had their guns
pulled."
The warrant for Hardy's arrest lists Detective G.A.
Lloyd as the arresting officer. Listed as state's witnesses
are narcotics Detective D.D. Minter, and Officers T.V.
Bowen and B.S. Setzer.
Lloyd, in a brief telephone interview Tuesday after
