C-370399-13 NOTICE TO BIDDERS Sealed bids will be received by the Winston-Salem/Forsyth County Utility Commission at the Office of the Purchasing Agent of the City of Winston-Salem, North Carolina, in the City Hall, Room 215, 101 North Main Street, until 1:55 p.m., local time, on the 26th day of JUNE, 1985, for furnishing materials, equipment and labor for the construction of the Lower Muddy Creek Wastewater Treatment Plant Sludge Handling and Disposal Facilities located in Forsyth County, North Carolina. All bids properly prepared and submitted will be opened and publicly read in the Council Chamber at the City Hall at 2:00 p.m,, local time, on the 26th day of JUNE. 1985. The Project consists of construction of sludge handling and disposal facilities for sludge generated by the 15 mgd Lower Muddy Creek Wastewater Treatment Plant presently under construction, The sludge handling and disposal facilities will include a 12.8 mgd lagoon system, belt filter presses, pumping and mixing facilities, associated building construction, piping and site work at the proposed site located in Forsyth County, North Carolina. The entire Project is divided into three contracts as follows: Contract No. 1 • General Contract No. 2 - Heating and Ventilating Contract No. 3 - Electrical PLEASE NOTE: Bids for Contract No. 1 - General Construction and Contract No. 3 •Electrical Construction have already been received for this project. Separate bids will be received for each Contract. Bids for Contract No. 1 will include lump sum and computed prices. Bids for Contract Nos. 2 and 3 wilt be lump sum bids. Each set of documents contains all the Drawings, Specifications and other Contract Documents for all three Contracts of the Project. The Drawings, Specifications and other Bidding Documents may be examined at the office of the Director of Public Works, City Hall, 101 North Main Street. Winston-Salem, North Carolina: at the offices of Malcolm Pirnie Inc., 301 Hiden Boulevard, Newport News, Virginia, and 2 Corporate Park Drive, White Plains, New York; at the Dodge Plan Rooms in Raleigh, Greensboro and Charlotte, North Carolina, and at offices of the Associated General Contractors in Raleigh, Triad and Charlotte, North Carolina. Copies of the Drawings, Specifications and other Bidding Documents may be obtained in per son or by mail from the Newport News Office of Malcolm Pirnie Inc. for a deposit of $150.00. All checks shall be made payable to Malcolm Pirnie Inc. Those requesting shipment of the documents will be charged a handling fee of $15.00 plus the actual cost of shipping, both of which charges are non-refundable. Neither the Commission nor the Engineer will be responsible for full or partial sets of Contract Documents, including addenda; obtained from any other source. The full deposit amount will be refunded to bidders who submit bona fide bids for the work, for up to two sets of documents upon return of the documents in good condition within fifteen days after the date of the opening of bids. Non-bidders will receive a refund of one-half the amount deposited upon return of the documents in good condition within fifteen days after the date of fhe opening of bids. No refunds will be made for documents returned after the fifteen-day period. Consideration will be given only to bids of contractors who submit evidence showing that they are licensed under "An Act to Regulate the Practice of General Contracting," ratified by the General Assembly of North Carolina on March 23, 1937, as subsequently amended, when such act is applicable. Qualifications of bidders to do the work proposed will be submitted with each proposal. Local, State and Federal laws and codes will be adhered to. The bidder shall place on the outside of the envelope or wrapping containing his bid and in his bid under his signature the following notification: "Registered North Carolina (epeoielty) Contractor No. Each bid shall be accompanied by a cashier's check or a certified check drawn on a bank or trust company insured by the Federal Deposit Insurance Corporation in an amount equal to not less than five percent of the gross amount of the proposal. Checks shall be made payable to the Winston-Salem/Forsyth County Utility Commis sion. In lieu of the above deposit of check, the bidder may execute a bid bond for the same amount and In the form provided, attaching the bonding company’s agent’s Power of Attorney to the page provided therefor. The successful bidder must furnish a 100-percent Performance Bond and a 100-percent Labor and Materials Bond with a Surety com pany satisfactory to the Commission. No bids may be withdrawn for a period of sixty days subsequent to the opening of bids without the consent of the commission. This project is to be financed in part by a Grant from the U.S. Environmental Protection Agency, Project EPA C-370399-13. Neither the United States nor any of its departments, agencies or employees is or will be a party to the Notice to Bidders or any resulting contract. EPA approval of the contractor is required prior to award. Bidders must comply with Title VI of the Civil Rights Act of 1964, The Davis-Bacon Act, the Anti-Kickback Act and the Contract Work Hours Standards Act and 40 CFR Part 33. Bidders must comply with the Department of Labor Safety and Health Regulations for construction promulgated under the Occupa tional Safety and Health Act of 1970 (PL 91-596) and under Section 107 of the Contract Work Hours and Safety Standards Act (PL 91-54). Bidders shall certify that they do not and will not maintain or pro vide for their employees any facility that is segregated on the basis of race, color, creed or national origin. Bids will be opened in public and read in the presence of those Interested, but the right is reserved to waive informalities. After bids are opened, they shall be evaluated in accordance with the methods and criteria set forth in the bidding documents. Unless all bids are rejected, award shall be made to the low, responsive and responsible bidder. Bid protest regulations will be as set forth in the Code of Federal Regulations, Title 40, Section CFR Part 33.
