Solicitor '? General Nominee ' Draws Bipartisan Praise WASHINGTON (AP) ? Drew S. Days IH was likened last Thursday to the late Justice Thurgood Mar shall as the Senate Judiciary Com mittee considered his nomination to become solicitor general. If confirmed, Days, a Yale law professor, would become the third black solicitor general, the govern ment's top representative before the Supreme Court. Marshall was the first, under President Johnson. The second was Wade H. McCree, who served during t he Carter administration. Sen. Carol Moseley-Braun, D-Ill., the Senate's lone black member, said she couldn't "help but notice the similarities between your career and the career of the late Justice Marshall," and that she could~"think of TfottHiT^rnore appropriate to honor the legacy of the late Justice Marshall than to confirm your appointment as solic itor general." Marshall, a longtime NAACP lawyer, earned a national reputa tion as a civil-rights attorney before Johnson chose him as solic itor general. His most famous case as a lawyer was the landmark Brown vs. Board of Education case ~ in 1954 that outlawed racial segre gation in public education. Days was an attorney for the NAACP Legal Defense Fund from ? 1969-to early 1977, when he became assistant attorney general in charge of the civil rights divi sion under President Carter. Sen. Orrin Hatch of Utah, the committee's ranking Republican member, joined in the praise. He said Clinton "could not have picked a better person." Days told the committee he was drawn to the job not only so he could "appear personally before the court in interesting and impor tant cases on a regular basis," but also to fill the solicitor's traditional role: of counseling the Supreme 4 Court, which Days described as f "almost judicial in its character." A 1966 Yale law graduate, Days worked briefly for a labor law firm before serving as a Peace Corps volunteer for two years in Honduras. While at the NAACP Legal Defense Fund, he also taught at Temple University School of Law. Since January 1981, he has taught at Yale.
