I write in respect to the leg-islation
generally referred to ir
Brunswick County as the "Recorders
Court Act".
This legislation, as passed b>

because it prevents them from
electing their Recorders Courl

December 1st, 1940, in acctAdance

of years; and because it
compels the people of the countyf
to accept as their judge and

by two legislators instead of

Deeds of Harnett County, among j1

From the moment the "Record- 1
; era Court Act" was passed citi- '
zens opposed to it and to all 1
, similar laws have worked to find *
'some means' by which' the laws 1
' could be set aside and the peo- 1
pie's rights to select and elect !
their own officers returned to the '
i people.
The opinion of the Attorney 1
;[General having been sought and 1
{found favorable to the legislation, 1
a court test was desired which J
-would develop the opinion of the 1
i Supreme Court on the matter. '
This court test came in con- i
nection with the office of Regis- (
i trar of Deeds of Harnett County. 1
The Supreme Court decision in '
this case, recently handed down, v
[ held that the Assembly had the v
: power to enact this type of law. 1
I This decision of the Supreme *
! Court is binding upon every citi- 1
zer. of the State. Under it all
I thought of securing abrogation 1
of the objectionable legislation
in time so that the citizens of
Ithis county may elect their Rejcorder
judge and Board of County
[Commissioners at tne next regu1
lar eleotion must be abandoned.
However, according to advice
i from good lawyers of both parties,
the people may if they wish
try to have the law repealed by
the next Assembly and if successful
in their attempt hold a
special election to fill the office
I for the time remaining after the
jlaw is repealed.
I understand that the Supreme
\ Court has held that any regular
session of the Assembly may, if
the public good requires it, termj
inate by act' of any office holder
and provide for filling the vacant
; office by special election or otherwise
as the Assembly deems fit ,
and proper.
' With this in mind I recommend
to the voters of Brunswick Counj
ty that they elect this time to ;

whenever he is convinced that a
majority of the people whom he
represents desire it, offer in the
Assembly and try to have enacted
a repealer to the Recorders
Court Act and similar laws affecting
Brunswick county; and
concurrently, a bill providing for
Et special election in the county
as soon as possible after the repealer
becomes effective, so that
the people of the county may fill
for themselves the office of Recorders
judge and County Commissioners
with persons elected
py the people.
It is my personal deep and
abiding conviction that such repealing
and enabling legislation
should oe had. Nevertheless, if
t were representing; 3runswick
bounty in the house at the next
session of the General Assembly
i would not move in the matter
mless and until I was assured bepond
any reasonable' doubt that
1 good majority of voters in the
county desired me to move. Therefore,
I believe that it is desirible
that the people express them-1
selves in the matter, formerly, by j
petition and otherwise as they
see fit, when the proper time
comes.
It is now my first purpose to
vork to elect to represent Brunsvick
County (in a State Assem>ly
composed almost entirely of'
Democrats) a Democrat who can
>e counted upon not to usurp to
limself for any reason powers
vhich I believe belong with the
electorate which sends him to
taleigh. When this has been accomplished
