I write in respect to the leg-islation generally referred to ir Brunswick County as the "Recorders Court Act". This legislation, as passed b> tiw last General Assembly, is ol interest to all voters in the county" because it prevents them from electing their Recorders Courl jufcge and the Board of County C<?nmissioners for two years beginning December 1st, 1940, in acctAdance with the traditional cuatofcn of years; and because it compels the people of the countyf to accept as their judge and tiyir governing body men selected by two legislators instead of m|n selected and elected by the pAple In free elections. ?s one of those Democrats wfco have been active in opposition to the Recorders Court act aikl all similar legislation, becaige we believe it takes cert?n of our rights as free citiz?is from all the citizens of this aLnty, I ask your space to irifctm my friends who have inquired of me as to what has 1 J J I* /... uaen uuj:t*. anu 11 sii) uimg iuitlier can be done to change the cqjhdition created by the passage oft these acts. iFrom the first moment that it? became known that our State Senator contemplated the enactrrlnt of such legislation numbers of the leading Democrats in the county joined together in makiA known their opposition to a y such legislation, and endeavo ed to persuade our legislators t< abandon their expressed intenti n of forcing it upon our peoP tOur Board of County Commiss iners, all Democrats, refused to g ve the proposed legislation their s fiction, or to have anything to d r with it officially. A member 0 ' the Board, acting in his private c pacity went to Raleigh and p otested enactment of the legis1: tion, and endeavored to make appearance against the bills before the house committee which Hftd the matter in charge. SThe county Democratic Executive Committee, at a public meeting held in the county court Suse after ample public notice, d called specifically to consider the contemplated legislation, held a public hearing in the matter [no 1 F< I will b EC *1 for the pur| . i; mric nn NNt m bUAO r 1 Exum?Bennt Cl!^B Freeland?Sir | Ash Post Offi || Longwood, Aj * Hickman's Gi ' Thomasboro, I Grissett Towr Lockwoods F Lockwoods F fc Boone's Neck s; Lockwoods F J , North West? if North West? i-M Winnabow?t I Bolivia?Apri p Shallotte?Po; }> rv^B - D 'I # H ? Notice l of this formal condemnation of their intentions by their party's ! governing body was sent to the: legislators. | Finally, private citizens in num-11 bers called personally upon our j legislators and urged them to |1 abandon all thought of any such legislation, at least until such11 time as the matter could be laid i ', before the people at an election ; [and the voters had expressed t 'their will in respect to it. i ] Despite all protests to the con- 1 I trary, pleading political expedi- j1 '1 ency and personal promises by'1 1 way of excuse, our legislators per-! sisted in placing the legislation!) before the Assembly and secured lj (r its passage by that body. Similar^ legislation was enacted at the same session of the Assembly af- J 1 fecting certain offices in various j * ; other counties, the offices affect- i' ed including that of Registrar of '3 Deeds of Harnett County, among j1 others. | From the moment the "Record- 1 ; era Court Act" was passed citi- ' zens opposed to it and to all 1 , similar laws have worked to find * 'some means' by which' the laws 1 ' could be set aside and the peo- 1 pie's rights to select and elect ! their own officers returned to the ' i people. The opinion of the Attorney 1 ;[General having been sought and 1 {found favorable to the legislation, 1 a court test was desired which J -would develop the opinion of the 1 i Supreme Court on the matter. ' This court test came in con- i nection with the office of Regis- ( i trar of Deeds of Harnett County. 1 The Supreme Court decision in ' this case, recently handed down, v [ held that the Assembly had the v : power to enact this type of law. 1 I This decision of the Supreme * ! Court is binding upon every citi- 1 zer. of the State. Under it all I thought of securing abrogation 1 of the objectionable legislation in time so that the citizens of Ithis county may elect their Rejcorder judge and Board of County [Commissioners at tne next regu1 lar eleotion must be abandoned. However, according to advice i from good lawyers of both parties, the people may if they wish try to have the law repealed by the next Assembly and if successful in their attempt hold a special election to fill the office I for the time remaining after the jlaw is repealed. I understand that the Supreme \ Court has held that any regular session of the Assembly may, if the public good requires it, termj inate by act' of any office holder and provide for filling the vacant ; office by special election or otherwise as the Assembly deems fit , and proper. ' With this in mind I recommend to the voters of Brunswick Counj ty that they elect this time to ; 3S55S25 TICE DURTH CALI e at the places cited pose of collecting ta ) Taxes May 1,1940 stt's Store, April 24th...... onions' Store, April 24 ce, April 24, pril 24, -oss Roads, April 24, ..... Tax Collector For E represent them in the General Assembly a Democrat'who will, whenever he is convinced that a majority of the people whom he represents desire it, offer in the Assembly and try to have enacted a repealer to the Recorders Court Act and similar laws affecting Brunswick county; and concurrently, a bill providing for Et special election in the county as soon as possible after the repealer becomes effective, so that the people of the county may fill for themselves the office of Recorders judge and County Commissioners with persons elected py the people. It is my personal deep and abiding conviction that such repealing and enabling legislation should oe had. Nevertheless, if t were representing; 3runswick bounty in the house at the next session of the General Assembly i would not move in the matter mless and until I was assured bepond any reasonable' doubt that 1 good majority of voters in the county desired me to move. Therefore, I believe that it is desirible that the people express them-1 selves in the matter, formerly, by j petition and otherwise as they see fit, when the proper time comes. It is now my first purpose to vork to elect to represent Brunsvick County (in a State Assem>ly composed almost entirely of' Democrats) a Democrat who can >e counted upon not to usurp to limself for any reason powers vhich I believe belong with the electorate which sends him to taleigh. When this has been accomplished I will be glad to work vith all citizens wno wisn to vork to secure a free selection I ind election of our Recorders Jourt judge and County Commislioners.
