Solicitor Duncan asked to have it recorded in the judgment that Powers is not to enjoy any spec ial liberties but must stay in the jail at night unless sent out of the coun ty. This was done. Elijah Blount Fulcher was convict ed of stealing a short gun valued at $ti.7.r from a boy by the name of Martin Luther Willis. Officers Seth Hughts and Iredell Salter searched his house and found the gun in a loft above the ceiling. Fulcher went on the stand and told a long tale a bout finding the gun in a swamp. This did not impress the Judge greatly though it appeared and so he said eight months and the costs for the defendant. John Lee, Negro, was tried on the charge of breaking into the store of Simon Martinos at New port and steal ing goods to the value of $500. Sher iff Davis searched the house recover ed several hundred dollars worth of merchandise said to have been stolen from the Martinos .store. Lee did not go on the stand but it is understood that he denies stealing the goods al though admits that they were stolen. Ho was bound over to Superior Court under a $500 bond. Five defendants plead guilty to the charge of playing a small game of poker, penny ante they said, and judgment was suspended on payment of costs. They were Cecil Dennis, Ben Harrison, John Guthrie, J. W. Guthrie Jr., F. Scotty, M. Kato. erty, to wit: One Whippet Sedan, .Motor 152124, serial No. 15043;).
