Allentown, Pa., Pan. 14-Alkus Eckstein, one of the lovers of ilab?l Bechtel, who was so mysteriously mur dered last October w;is acquitted yes terday or complicity in the crime after fi brief trial in which the conduct o" the prosecution sorely tn'ed the pa tience, not only of Judge Trexlei. but also of the jurymen and counsel for the defense. E. J. I.. Steinwalner. the district attorney of Lehigh county, was so befogged that it was with dif ficulty the case w is carried to a con clusion. Several times the court inter fered and threatened to end the pro ceedings for the '''iv unless the com monwealth conducted its case in a more orderly m:inr.?v. The couit endured the proceedings until after the jury had been instructed to render a "verdict of acquittal, when Judge Trex ier adjourned the court. The district attorney wanted to go ahead with the trial of the ac.-v.sed members of the Betchel family hut the attorneys for the Betcheis protested emphatically. The. district attorney, however, was insistent and ordered the jianies of the defendants celled, but the judge interrupted by saying to the dis trict attorney: "Do you intend to conduct the prose cution yourself or will you rely on as sistant counsel. If the latter, the trial rvrill go on. otherwise this court will adjourn tomorrow morning." "The district attorney proposes to conduct this case himself," muttered the official. 'Then this court stands adjourned until 9 o'clock tomorrow morning," or dered the judge. The opening address of Attorney Lutz, who is assisting the District At torney was exceedingly brief, and did Dot give a strong indication that the commonwealth expected to fasten com plicity in the murder on Eckstein. Eight witnesses were examined. The only point brought out was that Eck stein and Mabel had quarreled and that Eckstein is alleged to have said tc her: "You are trying to drive me to the grave, but you may get there be fore me." This testimony was given by Miss Brobst, Mabel's sister, who said she overheard the remark about Easter last year. David Weisenberger refused to an swer any questions put to him which referred to his relations with Mabel. Senator Hale's Resolution. (By Associated Press.) Washington, Jan. 11. In the Senate Mr. Hale offered a resolution as a re sult of the agreement between himself and Mr. Bacon, on looking to a set tlement of the Panama question, which after reciting the secession and recog nition of Panama, and th2 pendency of the'canal treaty in the Senate reads: "Resolved, that in any claim which the republic of Colombia in any form, may make against the Republic of Panama for indemnification or los3 of territory or increased burden of the debt of said republic of Colombia the President is requested to tender his best offices toward peaceable adjust ment of all controversies that have arisen, or may arise, between said re public of Colombia and the republic of Panama." Shot by a Negro. (By Associated Press.) Vicksburg. Mi., Jan. 14. C. C. Mc Millan, a planter and merchant of Mad ison Parish. La., was shot and fatally wounded by "Butch" Riley, a negro. After being shot McMillan drew his re volver and shot the, negro through both hands. Riley was captured and taken, to Tallulah and 'a message from there says the negro probably will be lynched. (By Associated Press.) Washington, Jan. 14. The following j statement is given outr by the State j Department concerning the treaty with j China, ratified yesterday. Although relating in its principal provisions to questions of commerce and navigation, removing restrictions which have hampered them both in China, it also treats of a number of questions of great importance to the people of the two countries. For ex ample it defines the rights and privi leges of the diplomatic officers and of American citizens and especially mis sionaries residing in China and insures the latter enjoyment of rights which they have only had in the past prac tically by toleration. The treaty also deals with trade marks, copyrights and patents ensuring them a fair de gree of protection in China a thing which they have had very little of in the past. "Perhaps the provision of the treaty which interests most the public is the opening of two new localties in Man churia to foreign trade the city of Mukden and the town of Antunk, on the Yalu river. It is to bo noted in this connection that the Japanese-Chinese treaty, the ratifications of which were exchanged at Tekin secures also to in ternational trade the opening of the .ort of Tatur.g Kou. about thirteen miles below Airtnng and at the mouth of the Yalu. WYNNE ON THE STAND. The First Assistant Postmaster-Gen eral Answers Inquiries. (By Associated Press.") Washington, Jan. 14. Robert L. Wynne. First Assistant Postmaster General, was the central figure in the postal trial yesterday, and w7hen court adjourned until Friday he was still on the stand. Mr. Wynne's testimony occupied most of the day, and he was subjected to a rigid cross-examination by Charles Douglass, counsel for the defense, during which the opposing at torneys had tilts, necessitating a word of admonition from Justice Pritchard that they must conduct the case in peace. The First Assistant Postmas ter General was plied with questions designed to test his knowledge of the duties of his oflice. The witness frankly stated that he had often signed papers prepared in Machen's division without examining into their contents. because they came to him in official j form, and because of the fact that he regarded Machen as one of the most expert men. in the service, and relied on him as to the correctness of his acts'. "Did you know that Mr. Machen knew his business?" Mr Wynne was asked "I knew that Mr Machen knew what he was doing," was the reply. "Did he know that you knew your business?" Mr. Douglass next inquired. He knows it now," was the quick retort, and the court crier was com pelled to rap for order. Counsel read a letter signed by Mr. Wynne, and dated as late as January, 1903, addressed to the Groffs, ordering 100 fasteners at 1.25 each, but Mr. Wynne said that an order for that number would probably not arrest his attention. John I. Howley, Mr. Wynne's chief clerk, occupied the stand for a brief time, the principal part of his testi mony relating to the fact that he sug gested to his superior officer the ad visability of examining into the legal ity of Machen's initials and signature placed cn letters and requisitions by Machen's subordinates.
