C, Feb. 10. There was a regular symposium of legal ar gument, heavy debate and cross-firing among the lawyers in the Samuel case yesterday morning. They had all spir ited up apparently to "make the last dash in the long race to the end, a spark of interest and excitement, as a reward for the patience shown by everybody during the long and often tedious proceedins. District Attorney Holton was prevented by the ruling of the court from getting in some of his usual final testimonal pyrotechnics, and so the case just died out eviden cial fire. He tried to show by Collec tor Harkins that he had never said to "Revenue Agent Chapman a word about Green's being Blackburn's man. The defense has from the inception of the case in cross examination oi all witnesses, endeavored to make the impression that these particular offi cers were bing prosecuted and per secuted on account of their strong al legiance to Blackburn in the campaign for his nomination at Wilkesboro and his election afterwards. Yesterday they held up their hands in holy legal horror at the bare suggestion of let ting in evidence tending to show that Col. Chapman 'had made a false statement to this effect on the ground that it was collateral matter and the District Attorney's statements or of ficial action could not possibly be com petent as establishing the guilt or proving the innocence of Samuel. And so all that was interesting of Collector Harkins' evidence was denied a wait ing audience. And so it was with the Register of Deeds Blevins. Everybody, however, was truly re joiced that the case is closed and bids fair to be at an end in a' few days. Yesterday afternoon when court convened Solicitor General Hayes an nounced that during the recess Dis trict Attorney Holton had received intelligence that his brother, Hon. John Q. Holton, of Yadkinviile, was dying of pneumonia, and he left for Winston at once. On account of his absence the counts he proposed to eliminate from the bill of indictment had not been ascertained and it will be done later. Judge Boyd then ask ed how long the atorneys desired to speak, saying when so many were go ing to speak it would be best to place some limit. Mr. Watson said he thought two hours each would be as little as the four for the defense could get. along with. Judge Boyd then set the limit on each side, and immediate ly Mr. Britt, special assistant Dis trict Attorney bega the opening argu ment for the prosecution, speaking ex actly two hours. At the conclusion the court took a recess until today, when Judge Bynum will speak for the de fendant. Court will then take a recess until Monday. The opening argument of Mr. Britt was a powerful one. Without a sin gle note of evidence he marshalled facts bearing on the counts charging false reports and collusion with dis tillers on the part of Samuel that were overwhelmingly effective. Tak ing the defendant's sworn testimony and comparing it iwth his sworn re ports to the Government he claimed conviction on his false testimony alone. He drew a striking picture of the officer in the toils of Jim Combs. He showed how step by step Combs had corrupted him until he actually brought him to Greensboro, introduced him to the Revenue Agent and then began the departure of this officer from the service of the government, into the service of the blockaders in hounding down the special officers sent to investigate the frauds, and put ting every conceivable construction in the way of the District Attorney's ef forts to obtain the facts. He describ ed the change in Wilkes countv blnrk. ading circles as soon as Officer Green reached there, saying that no revolu tion had ever brought about so quick ly such a miraculous change as had been wrought by one honest deputy collector destroying the whole fabric of blockade conspiracy as did Green when he cut Jim Combs' still up and proceeded to cut others, showing that the scepter had departed from Samuel and Combs.
