10 COMMITTEE REPORT Oil THE AFFAIRS OF INSURANCE GO'S. . (Continued from page one) Sa A W recommend that the legislature at tempt to prescribe the expenditure of the insurance corporations. The Legis lature cannot undertake the manage ment of the business. The evidence, however, makes it clear (hat the most wasteful expense lies in the amount paid for new busi ness. By a limitation of their new busi ness the three great companies will be able very largely to diminish their agency expenses. The committee does not recommend that the rate of com missions be prescribed by law. It is recommended that the commis sions should be uniform. The commit tee recommends that the law be amended so that the minimum stan dard for valuation of policies other than industrial should be established. The superintendent of insurance should be required to fix the legal mini mum standard. The committee recommends an amending of the penal code to provide that a person receiving a rebate should be equally guilty with one who gives it. Surrender values with regard to the new policies, the provisions of the statute should be liberalised and the insurance in the absence of notice from the policy holder should be automati cally continued for its full amount as long as the reserve upon his policy will justify. Remedies of policy holders: Assum ming that the funds belonging to the policy holders through the opportuni ties afforded by deferred dividend con tracts have been wasted through lax and corrupt administration, and that not only have the shares of the profits for policy holders been determined by secret and arbitrary methods of com nutation. but that the policy-holders have been denied an opportunity to seek relief in the courts. The commit tee recommends the repeal of the ex isting law which provides that the ac tion by the Attorney General should be the condition precedent to an order, judgment or decree for an accounting and that the matter should be left sub ject to the general provisions of the articles of the code relating to actions against corporations. The committee . recommends the adoption of a standard form of policies in clear and concise language. Recommendation is made for the fullest publicity in insurance matters on the pain of penalties for viola tion. Committee concluded: "Most of the evils which have been discarded by'the investigation would have been impos sible had there been a vigorous per formance of the duties already laid upon the department, a vigilant watch fulness in the interest of policy holders and a courageous exercise of the powers which the statutes confers." Reoort Was Presented. Albany, N. Y., Feb. 22. The report of the Armstrong special insurance in vestigating committee' was presented in both houses of the Legislature to day. It was accompanied by eight bills designed to carry into effect the de tail of the recommendations of the committee. In a statement made to newspaper men before the presentation of the re port, Senator Armstrong said he hoped to have passed before April 15, the bill which will defer the annual election in the Mutual companies from April 15 to November 15. This, it is believed, probably wrould nullify all proxies obtained up to this time by Thomas W.
