Open Saturdays. 12 South Church St. Pickpockets Get in Very Good Work That a professional pickpocket is plying his nefarious avocation in Char lotte is the belief of many, the con viction being the more pronounced by five persons who have mysteriously lost sums of money within the past week. Reports have been made that tend to lead one to confirm the sus picion that a pickpocket, or a gang of such people, is working in the city and is especially active on Saturdays. A lady of Garland Court lost a purse containing a small sum of mon ey and is confident that a thief got the amount. Mr. W. A. Torrnce lost his pocket- book containing between $20 and $25. He, too, believes that his pocket was picked. But like the others w^ho have reported robberies he has no clue to the identity of the miscreant. Mr. J. G. Stikeleather is perhaps the heaviest loser. In his purse that was stolen was $129 in bills. He be lieves that some one saw' him* place the money in his purse and follow'ed him until an opportunity was offered to pick his pocket. Mr. J. S. Rhyme was “touched” for $10 and Mr. John M. Laughlin lost $15, a $10 bill and a $5 bill from the small pocket of his trousers. Both of the latter gentleman had just re cently cashed checks and were seen to get money from the paying teller’s window. They are thought to have been followed and the stealing of the money was afterwards an easy job for the member of the lightfingered gen try. Church Note. Dr. H. K. That is the w'ord most fitted to ex press the surface conditions apparant- ly existing now" betw'een Assistant City Attorney J. L. DeLaney and Re corder D. B. Smith. Clash! Beginning Friday morning when Re corder Smith justified his decision of acquittal of the manager of the Park Driving Club by remarking that charges of so serious a nature should not be brought before him upon such evidence as was adduced by the prose cution, the differences of opinion ap pear to be more striking. Fail ing to secure a conviction of Mr. Wil son, the club manager on the charge of retailing, Mr. DeLaney, acting in his oflicial capacity, asked for the ser vice of papers upon Wilson to force him to show cause w'^hy he should not be fined for failure to properly return to the city upon the prescribed time a list of members of the club. Clash! Recorder Smith inquired of Sergeant Scullion if all clubs had properly filed lists of new members and remarked that it would be useless to serve an in dictment upon one party unless all w^ere brought into court. Clash! Mr. DeLaney learned w'hat had been said by Recorder Smith and demanded that papers be served on Wilson, whom he alleges has practically admit ted a violation of the ordinance w'hich compels club managers to file a list of names of new members. The po lice servied the papers in the after noon, the suggestion, or instruction, of Mr. Smith to the contrary, notwith standing. And in the air there is a feeling akin to strife. Something is brew'ing and only development will bring out the details of the, clash! An effort w^as made last night to get in communication with Recorder Smith, but he could not be located. The police in the afternoon served pa pers on L. O. Wilson, manager of the Park Driving Club, notifying him to appear in police court on the 8th of February to show cause w^hy he should not be fined for failure to comply with the city ordinance regarding the filing of names of new' members of the or ganization. In the event of a conviction upon the charge, it is understood, the mayor will be asked to revoke the license of the club. FOR MILK AND CREAM ’Phone 1038. No. 32 Howell Arcade, City Attorney Makes Statement. To The Editor of The News: In your report of the proceedings in the recorder’s court on the 27th, you had this to say in reference to the trial and acquittal of L. O. Wilson, charged wnth retailing: “Refuting the allegation of L. B. Forrest, a non-resident, that he has purchased whiskey in the Park Driv ing Club from L. O. Wilson, the man ager, testimony was offered in th#: re corder’s court this morning that exon erated Mr. Wilson from the serious charge. Recorder Smith dwelling rath er more than custt)rnary upon the char acter of the evidcace adduced and. in the slightest kind of v/ay, although kindly, criticising Assistant City At torney DeLaney, w'ho prosecuted the case.” Prom the reading of the above arti cle the public would gather the im pression that I had indicted Mr. Wil son upon evidence which did not merit even the consideration of the court, appearing upon its face untrue. In view of this fact, I w’ant to submit the evidence which I acted upon in this case. L. B. Forrest on last Monday, w’hile being tried for being drunk, testified that on Saturday night he w'ent in com pany with B. H. Graham to the Park Driving Club and there got two drinks of whiskey for twenty-five cents and one pint for seventy-five cents from L. O. Wilson. B. H. Graham went on the stand and said yes, he v/ent with Forrest to the Park Driving Club and they got the liquor, as Forrest said, but that Forrest did not pay for it— though, he admitted that Forrest laid the money on the table. Graham said the liquor w'as his, that he w'as a member of the club. I asked him w'hen he joined the club? He w^as un^,ble to answer. I asked him how much liquor he had at the club? He w^as unable to answ^er. I asked him w’^hat his locker number w'as? He w^as unable to anser. I asked him w'hat fees are charged him when ho joined the club? He w'as unable to answer. I asked him where he had gotten the w'hiskey he had in the club? He squirmed and twisted for sometime and apparently in doubt said. Black & Sparks, of Richmond. There is a city ordinance requiring the clubs to furnish the desk sergeant on the first of each month a list of rew members joining the club during the preceding month. Graham’s name had not been furnished as the above ordinance requires. In a few minutes after court adjourned, some boy came in the gave the chief a list of new members of the Park Driving Club among which was B. H. Graham. The list W’as dated December 1, 1910, and signed by L. O. Wilson, manager. I W'as then satisfied that B. H. Graham was not a bona-fide member of the club, and w’as further satisfied that Forrest got the liquor in the club be cause he was corroborated by Gra ham, and I w^as further satisfied that Forrest paid the money for it as he said he did, because Graham says For rest threw the money on the table. Now, that Is the evidence w’hich I acted upon. Forrest’S character stands unimpeached, and so far as I knew' then and so far as I know, now' his character is as good as any man’s. He certainly told a reasonable story. Why should I discredit his statement? There was no motive why he should tell a lie about it. I did not have the evidence of the, defence to consider along with the state’s evidence, but w'ill state frankly that if I had had it would not have changed my opinion. I W'as critisized by his honor and critisized unjustly, and had it not reach the public in the one sided man ner in which it has I would not'have written this article. His honor in his criticism went on to say that I ought to be Tair with the court and not bring these indictments against the clubs with the character of evidence that I had in this case. This may not be the exact language of rv, n substance i, ther said that the by the reports of ' pose he refers to rhe ' state's evidence in hm' cases.
