Now, therefore, it is ordered that the space covered by the tracks of said street railroad and other rail road companies and thirty Inches on each side of each line of track as they are now or may hereafter be constructed by any such company, on any street or streets in such per manent improvement districts or sections, shall be paved by said com panies w'ith such permanent Im provement material as shall be ordered by the executive board of the city of Charlotte, provided, how ever, that the mayor of the city of Charlotte shall execute In the name of the city a contract with said company agreeing to repay to said company the amount of the difference between the cost of paving the space covered by Its tracks together with thirty inches on each side of each line of tracks as they are now or may hereafter be constructed, and the cost of paving the space covered by Its tracks, together with railroad company, as that covered by the space between said tracks and inches as aforesaid on each side of each line of track, to assess the difference between the thirty inches and as may be legal and proper, but without any right to further assess the ssUd street rail road and other railroad companies than for the cost of paving the space covered by the tracks and inches on each side of eaoh line of track as aforesaid, in case the courts f)f this state having jurisdiction shall hold that It is within the discretion and power of this board to order less than the space covered by its tra,ck and thirty Inches on each side thereof to be paved by such company. Separate Note. If said companies after notice to do said paving shall refuse to do so, then the said paving shall be done by the city of Charlotte with such permanent Improvement material as shall be ordered by the executive board and the cost thereof &hall be assessed against said street railroad and other railroad companies as pro vided in the amended charter, pro vided, how'ever, that, in case such street railroad or other company shall execute to the city of Charlotte its notes covering the cost of paving the space covered by its tracks? and inches on each side of each line of track as they are now or may hereafter be constructed by any such company and payable in ten equal Installments one each year until the expiration of ten years, or separate notes for the respective in- slailments, then said company shall be allowed to execute to the city other notes payable at the same times covering the space betw'een thirty inches and inches on each &ide of each line of track as before stated, said last executed notes conditioned to be null and void in case the courts having jurisdiction thereof shall decide that it is within the discretion and power of the board of aldermen to prescribe the amount of paying to be done by said company as the space covered'by its tracks and inches on each side of each line oftrack as they are nov>- or may hereafter be con structed by any such company. To Compel Company. It is further provided that in case said company shall not do the work or give its notes as aforesaid, then the proviso in regard to the com pany’s executing the aforesaid con ditional notes which Is a clause in serted in the exercise of such dis cretion as the board of aldermen may have In fixing the amount of paving to be done by such company, and the assessment of the amount of cost thereof, as based upon the space covered by Its tracks and Inches each side of each line^ of said track, and for the purpose of settling the difference between the city of Charlotte and said company, or companies, which mus-t take ad vantage thereof by strictly complying with the terms hereof, as null and void, and in that case the. said rail way company not executing its notes according to the terms hereof shall be assessed the amount of cost of permanently paving the space covered by Its tracks and thirty inphes on each side of each line of tracks which may now or hereafter be construct ed. The owners of the property on each side of the street or streets in permanent improvement districts or sections now^ or hereafter laid out in which permanent paving shall be done before the 1st day of May, 1913, through or along which tracks of any street* railroad or other railroad company s^all run are hereby as sessed according to the amount of their frontage on the respective streets, and up to a line thirty Inches from each side of each line of track of said company. Would Compel Mayor. “I move,” said Alderman Mason, “that we stand by our ordinance as already passed and Instruct the mayor to sign it.” The Mayor: "I have already said, Mr. Mason, that the act is Illegal and that I will not sign an illegal act.” Mr. Gulllet: “Will the aldermen be personally held responsible?’ “The case of State against Hatch is pretty strong,” said Mr. Brenlzer. T don’t know what that is,” the alderman replied. “Well, it provides that any officer who is guilty of neglect of duty shall be guilty of a misdemeanor.” “Misdemeanor! Is that all?” asked Alderman Phifer. “Alderman Williams: “I shall re fuse to support Mr. Mason’s motion,” I came here tonight prepared to stand by my vote, but I am unwilling to vote to put the mayor in a hole by making him sign something to which he is op posed.” Aldermen Sifford expressed himself likewise. Alderman Landis: “I am willing to be arrested. I want to go on record as standing by my vote.” “Well, what are we going to do?” demanded Alderman Kistler. “Are we going to saddle $200,000.. on this cor poration starting out here in its infan cy and squash it?’ Dr. Austin said he thought the mat ter would be settled by the city attor ney’s ordinance, but when he went to Mr. I^ee’s office he found a whole dec laration of independence in the way of a contract to be signed and he was opposed to It. He moved the amount be fixed at 30 Inches and the reductictn made for this year only. At this point Mr. Mason withdrew his motion to compel a signature. “I’m done with this business,” he declared. ‘I’m not going to vote on It any more, one w’ay or the other. No matter which way we vote, we are told that we did wrong. “I move we adjourn,” said some one. “I second it,” said everyone. To be continued. MAY SUCCEED DR. VINES. Special to The News. Waller, pastor of the Deaderlck Street church of Knoxville, has been asked to preach here Wednesday night by the committee appointed to fill the vacancy of the pastorate of the First Baptist chiurch made by the resignation of Rev. W. M. Vines, who accepfed the pastorate of the First Baptist church ot St. Joseph, Mo. It is understood that Mr. Well er is being considered by the com mittee and it Is likely that his call will depend on the impression he makes on the members while here. Mr. Weller I a young man and has just about completed a costly church at Knoxville. The committee visited his church recently and were very much pleased with Mr. Waller. Caldwell died yesterday morning at the home of his parents on Center street. The child, which was about 11 months old, had been ill only two or three days, sntt'«ir- Ing from cholera infantum, and its death was rather unexpected. The fu neral and interment w'ill take place today. Much sympathy is expressed for the bereaved parents.
