Tnere are three of the Smiths, father aodgons, and the officers were R. A. Mays, a revenue em ploye, and a posseman, Mr. Rose. The Smiths are well known to the federal officers. They are William Smith, the father, Flet cher and Jim, the sons. Jim Smith | was tried for his life in the district court here some years ago, being charged with taking part in the alleged conspiracy which preced ed the. killing by Stokes county moonshiners of Revenue Officer Hendrix. He was acquitted and no one was ever punished for the death of the officer. At that time Smith was convicted of illi cit distilling and given the ex treme penalty under the law in the penitentiary at Atlanta. Fletcher Smith was convicted recently in Danville, Va., for illicit distilling on the Vir ginia side of the line, and was giyen a sentence of one year. I Mays and Ross put up a fight against the band of men who at tacked them. Although serious ly wounded, Mays shot the men under indictment, it is allegea.
