The development followed u judgment handed down at Wiikes boro in the alternoon by Jui;.,e H. Hoyle Sink that state U.v makes no provisions for a pri mary in the district and that candidates for the state Serve should be named by convention. The court ruling was given af ter a voluntary nonsuit was taken by Kirkman in his petition for a writ of mandamus to force his nam e on the official primary ballot in defiance of a roll.' ! precedent for the alternation :>f candidates between Stokes a., i Surry counties. Kirkman demanded an investi gation by Attorney-Gene.'al A. A. F. Seawell in a telegram sent ■from here last night.
