( Staff Photo by Howard Jones ) Agriculturally Speaking By RLSSELI. C. KING County Extension Director Revision of the Immigration and Nationality Act (INA) requires employers of "special agricultural workers" and "replenishment agricultural workers" employed in seasonal agricultural services to assemble employment information which must be reported to the Federal Government during the .jeriod of October 1, 1988, through September 30, 1992; essentially the same employment information that must be reported to any individual replenishment agricultural worker during the period beginning October 1, 1989 through Septem ber 30, 1992. The INA provides for assessment of civil money penalties of up to $1,000 for each occurrence for, among other things, failure to provide, or failure to provide accurately, the required information. To carry out the statutory requirements, employers must: 1 identify each reportable worker employed in seasonal agricultural services subject to the regulations issued September 9, 1988 ; 2 report to the Federal Government the number of work days per formed by any such reportable worker, and 3-report the number of work days performed to each reportable worker who is a replenish ment agricultural worker. Federal workers need the required information from employers in order to decide how many "replenishment agricultural workers" (RAWS) may obtain legal status during each of four fiscal years. Congress anticipated attrition of legally employable persons, in cluding even those recently legalized as "special agricultural workers" (SAWS) from the farm labor supply. It built into IRCA provisions for replenishing the agricultural workforce by allowing aliens to enter the U.S. as RAWS from October 1, 1989, through Sep tember 30, 1993. To assist you in completing these reports, plan to attend the ESA-92 report workshop at 1:00 p.m. on January 11, 1989 at the Warren County Agricultural Office.
