In rcsjionse to yrur re quest of thii thtc I have examined chapter 150, laws cf 1SS3 and chapter 78, laws of 18S7 amendatory thereof, extending the period of annual settle ment with the State Treasurer by the tax collectors of 'he counties 01 Rock ingham, Guilford, Caswell. Orange; Durham, Person, Gram-lie, Vance, Forsyth, Stokes, Yadkin, Surry, .Bun combe, Haywood, tadison, Davidson, Rowan and Davie "until the first day of May in each and every year." It seems to me quite clear that this act only applies to thoc taxes which arc required to be paid into the State Treasury, and docs not embrace those imposed for idiocl purposes, which, while levied by specific enactment of the General Assembly, are required to be accounted for and paid to the Coun ty Treasurer and disbursed under tlie sujervisicn of the county authorities. The Code, sections -2,552-2,565. The State Treasuicr has nothing to do with them. Th; amendatory act referred to provides that "the sheriffs of the counties mentioned in this sec tion" (s.ction 1, chapter 150, laws 1SS3) "shall not levy on property or sj'i un der execution until after the fifteenth day of March." It is obvious that this provision only applies to these taxes mentioned in the act of which it is amendatary, to-wit, taxes required to be paid into the State treasury. This construction is justified not on ly by the wording of tnc acts, but uqion principles of sou nil public policy. A different interpretation would suspend for many months, if not entirely destroy the public schools within the counties named, and disorganize the general and nniu rr.i svstem of public education provided by our laws. It will not be presumed that the general assembly contemplated such a purpose in the en actment of thcc statute.
