Garrow brings appeal to Faculty Committee

David J. Garrow, an assistant professor in
the UNC political science department, pre
sented his appeal for reappointment to the fac
ulty before the Faculty Hearings Committee
Wednesday.
Monday, both Garrow and his attorney,
Gregory B. Craig of the Washington-based
Williams and Connolly law firm, declined to
comment on the hearing.
The appeal was the latest action in a three
month long process that began on March 21
when political science department Chairman
James W. Prothro decided not to reappoint
Garrow after his current term expires in De
cember 1984. The decision was based on a 10-9
faculty vote against the reappointment.

wor's work, that Garrow had not made a con
tribution to the general quality and reputation
of the department, and that his work is not in
the subfield of public law, which Prothro said
was an understanding in Garrow's hiring.
In accordance with the University's Tenure
Document, Garrow then requested a private
conference with Prothro to discuss the reasons
for the nonreappointment. He also wrote a
seven-page memo defending his works and his
teaching ability. Prothro subsequently denied
Garrow's request for reappointment in a letter
dated April 11.
Garrow then appealed to David H. Moreau,
acting dean of the College of Arts and Sci
ences, but Moreau said in a letter dated April
29 that he did not have any particular evidence
for reversing Prothro's decision. : r-
According to the Tenure Document, there
are three impermissible grounds for nonreap
pointment: the faculty member exercising his
right to t freedom of speech; discrimination
based on race, sex, religion or national origin;
and personal malice. Garrow could appeal to
the hearings committee only on the grounds
that one of these impermissible reasons was
behind the decision that he not be reappointed.
After hearing Garrow's appeal on Wednes
day, the committee was to determine whether
the decision against his reappointment was
based on one of the impermissible grounds. If
so, the political science department will pre
sent its case today.
If the committee decided the basis for the
nonreappointment was valid, the hearing
would go no further. In that case, according to
the Tenure Document, Garrow would have 10
days to appeal to the Board of Trustees. He
said Monday that he had not yet discussed the
possibility of such an appeal with his attorney.
The Faculty Hearings Committee a standing
committee of five professors, only three of
whom must be present at the hearing. The Ten
ure Document states that if the committee
does rule in Garrow's favor, it must present a
written recommendation for corrective action
to Garrow and Prothro.
Garrow said he has not thought about what
he will do after his contract expires if he is not
reappointed.

Lois Dawson should have been identified as an
assistant director of Undergraduate Admis
sions, and Lorraine Satterwhite should have
been identified as vice chancellor for Univer
sity affairs.

. and economically disadvantaged high school
juniors. She also said the program does not
look for students with low SAT scores, but it
tries to involve students whose records indicate
they will perform well at and contribute to the
University.
