Garrow case continues

Tar Heel Staff Writer
David J. Garrow, an assistant professor in
the UNC political science department, received
a letter from the Faculty Hearings Committee
on June 27 concerning his appeal for reap
pointment in 1984.
Garrow declined to comment on the con
tents of the letter Tuesday night. He said his
legal representatives, Williams and Connolly
of Washington, D.C. , have advised him not to
reveal the contents of the FHC recommenda
tion letter for at least another couple of weeks.
James W. Prothro, chairman of the political
science department, decided not to reappoint
Garrow when his contract expires in 1984.
Prothro wrote Garrow a letter dated March 23
stating that the decision was based on an in
sufficient level of scholarship shown in Gar
row's work and that his work was not in the
subfield of public law.
Prothro also based the decision on a March
21 faculty vote 10-9 not to reappoint Garrow.
Garrow appealed to David H. Moreau, act
ing dean of the College of Arts and Sciences
but was turned down when Moreau supported
Prothro's decision in April.
The FHC was headed by Chairman James
E. Littlefield through June 30 and includes
five members who are elected on a five-year
staggered term. -. -. .

Garrow requested a conference with Pro
thro and also wrote a seven-page memo, to
Prothro in defense of his work. However,
Prothro denied his request for reappointment
in an April 11 letter.
Littlefield said that if the appeals committee
found the basis for Garrow's nonreappoint
ment legal the case would not go any further.
According to the Tenure Document, Garrow
could appeal to the Board of Trustees for con
sideration. The Tenure Document states three imper
missible grounds for nonreappointment: the
faculty member exercising his right to freedom
of speech; discrimination based on race, sex,
religion or national origin; and personal
malice. :
Garrow's works include two books concern
ing the civil rights movement: The FBI and
Martin Luther King Jr.: From 'Soo to Mem
phis and Protest at Selma: Martin Luther King
Jr., and the Voting Rights Act of 1965, which
received the Southern Political Science Associ
ation's Chastain Award for the best book on
government in the South in 1978.
