Once it did begin action, the Republican-controlled Senate voted 53-36 to knock out the domestic money sought by Democrats. Both houses waded through raucous partisan squabbles and filibusters as a midnight deadline ap proached. RALEIGH Superior Court Judge Charles T. Kivett's resignation was announced Thursday as his attorneys asked the state Supreme Court to reject a panel's finding that Kivett is Unfit to be a judge. "Regardless of the outcome of this proceeding he feels he cannot be an effective judge in Superior Court any longer because of the notoriety sur rounding the case," said Norman Smith of Greens boro, one of Kivett's attorneys. "He does not acknowledge any wrongdoing on his part." The N.C. Judicial Standards Commission has recommended Kivett, 55, become the state's first Superior Court judge to be dismissed. The com mission said Kivett allowed himself to be improperly influenced by a Wilkes County friend and engaged in illicit sex, once with a woman he later helped in a criminal matter before his court. I think the key to doing this job correctly is to judge their background within the scope of their own par ticular environment. For instance, kids who come from poor families don't get the same parental push to perform or to take courses. So, when you're deal ing with a youngster who comes from a poor situation and is the first generation to go to college then you really have to judge what that individual did different ly, in a test score sense, performance sense and a course selection sense. It's too simplistic to base it on racial lines because you expect a black youngster who goes to Andover to be just as well prepared academically and have the same sort of credentials that anybody else does. However, either a white kid or a black kid who comes from an exceptionally poor circumstance has got to be treated differently by this office. What you've got to be careful about is putting the poor kid, or the kid who hasn't had the push, in a situation in which he or she cannot handle. On its second try of the week, the House passed its version of the spending measure 224-189, complete with nearly $1 billion worth of additional education and social spending that Republicans said would draw a veto from President Reagan. Senate consideration of the measure at first bogg TOKYO President Reagan, making no ap parent headway in his bid to expand American access to Japanese markets, appealed to this country's legis lators Friday for help in shrinking the huge U.S. trade deficit that is giving him political headaches at home. In a prepared speech, the first by an American president before the Diet, the Japanese parliament, Reagan said, "We need your help in demonstrating free trade to address concerns of my own people."
