Spangler released parts of reports from the nine Division i campuses Oct. 23, after refusing two requests from N&O reporters to make the reports public earlier in October. Athletes' SAT scores and graduation rates have been made public, but Spangler has not released the chan cellors' special reports. In an affidavit to the Wake Superior Court written Oct. 31, Spangler said he was using the reports to prepare a report of his own, which he would present at the BOG's meeting Friday. Spangler said that he had not yet read or studied the chancellors' special reports, and that he would use the reports with other sources of information and opinion to produce his report to the board. North Carolina law defines a public record as a document made H or man or received to carry out a law or ordinance, connected to any state agency's transaction of public business. According to the law, public officials must make public records available "at reasonable times." In his affidavit, Spangler said the NCPA and The News and Observer Publishing Co. had charged that the athletic reports were public records before he used them to compile his own report. "Thus, any drafts of the report that 1 may prepare presumably also would be instantly available to representatives of the press, as soon as those various drafts were removed from the typewriter of my secretary," Spangler said in the affidavit.
