North Carolina FRIDAY, APRIL 16. 1954 Liquor Case In Court Monday Features [Delegates To Display Of 11 Jars Of White Whiskey Local Man Given Three Months For Theft Bottle Wine Eleven jars of non-taxpaid white whiskey and a bottle of taxpaid wine comprised an unus ually large exhibit of beverages displayed on the table before Sol- ititor W. Lament Brown in re corders court at Carthage Monday. The whiskey figured in a case that brought a six months term to the reads, from which he appeal ed, to Ossie Ransom Dowdy, Car thage Negro, while a Southern Pines Negro, Hercules Pew, was convicted of stealing the wine from the Colonial Store here and was sentenced to three months on the roads. Defendants in both cases vig orously pled not guilty and offer ed detailed explanations of their alleged innocence but their stories were unconvincing to Judge J. Vance Rowe, in view of the eye witness testimony of ABC offi cers in one case and Colonial Store employees in the other. Chief ABC Officer C. A. Mc- Callum, Officers Keith Marks and John Sharpe and Deputy Sheriff A. W. Lambert testified they had seen Dowdy on a rural road—^less than a week after he received a suspended sentence of four months on the roads on a liquor charge—open a case of 12 jars of white liquor, remove one, hide the othehs and walk away. Officer Marks, who gave chas# to Dowdy on foot, ruefully admitted the stocky Negro had outrun him and had disappeared in the WBods. Dowdy claimed he just happen ed to find the whiskey and hid the jars for future reference. He said he was broke and had to bor row 20 cents to finish paying the $75 fine and costs in lieu of the four months sentence in the other liquer case tried in recorders court a few days previously. Judge Rowe sentenced Dowdy to six months on the roads on charges of possessing illicit liquor for purposes of sale, also removing and concealing liquor. The four months suspended sentence was ordered into effect to run concur rently with the six months. Dow dy appealed and bond was set at $500. Wine Case Hercules Pew said he had gone to the Colonial Store Saturday morning about 11:30 and had bought a fifth of wine. He said he left the store, threw away the bag and the cash register receipt and put the wine in a back pock et under his coat. Then, he testi fied, he went back in the store to buy some sardines which, with the wine, were destined to be his lunch. He said he bought two cans of sardines and was stopped by the store manager as he left the building with the request that he pay for the wine. The manager, on the other hand, testified that he saw Pew put the wine in his pocket while he was in the store and that he then left, paying for the sardines Meeting Named but not the wine. The three months sentence carried the judge’s recommendation that de fendant be examined physically and assigned to suitable work, as Pew had testified he had recov ered from tuberculosis. It was also brought out by Sol icitor Brown and the testimony cf Deputy Sheriff A. F. Dees of Aberdeen that Pew had been drunk at the Mid Pines golf course and had repeatedly been drunk on the job as a caddy and had been forbidden tO work there but still went back and would not leave when asked to do so on one occasion. The solicitor cited a report that Pew had been so drunk during one round of golf that he had to stop caddying after five holes and a replacement had to be sent for him. The defendant said of this report that he was only tired. Marvin Wilkes McRae, Eagle Springs, speeding, accident, judg ment continued on payment of costs (nobody- else involved); Johnnie Lassiter, Vass, careless and reckless driving, accident, $25; Emory Edwards Brooks, Carthage, careless and reckless driving, $25; Alex Goins, West End, driv-. ing without license, $25; Charlie Perkins, Aberdeen, crime against nature, capias issued for appear ance Tuesday, April 20, bond set $200—(the warrant in this case, taken out by Cassie Stevenson, charges that Perkins forced Wil liam Brown, 16, off the highway to a secluded place and forced Brown to submit to “an act of crime against nature”); Douglas Garner, Carthage, Route, public drunkenness, disturbing peace, as sault, and Blake Garner, Carthage, Route, disturbing peace, cursing, assault—each 60 days or the costs and good behavior toward Mrs. Britt for the next two years, ap peal entered, bond set at $250.
