SEPTEMBER 27. 195S Chapel Hill Auto Dealer Convicted ^ ■ A ^ ^ 1 4-T-i T/^ The fact that an automobile dealer needs a driver’s license in his business and would be “em barrassed” if he lost it completely, failed as an appeal to Judge J. Vance Rowe in Moore Recorder’s Court Monday. Alfred Douglas Yates, Chapel Hiil automobile dealer, had been .. caught speeding August 30 on US Highway 1 south of Vass by State * Highway Patrolman E. G. Sho- maker. Shomaker had charged him with doing 75 miles per hour. In court Monday Yates, through his attorney, James Farlow of Chapel Hill, entered a plea of guilty to driving 65, but denied the faster speed, saying his speed ometer was obviously out of kil ter. Farlow had a bill from a gar age attesting to the fact that the speedometer on Yates’ car had been repaired but the bill was not allowed as evidence. On cross examination by Solici tor W. Lamont Brown, Yates ad mitted having a record for speed ing and careless driving. In passing sentence, a fine of $35 and costs, plus the automatic suspension of Yates’ license. Judge Rowe said it was not always the so-called “criminal” type who broke laws. Indeed, he suggested, many times some of the most re spected citizens of a community break the laws and then try to avoid conviction solely on their reputations. Yates appealed the sentence to Superior Court.' Bond was fixed at $100. Other cases disposed of: Nelson Burgess, Jr., Fort Bragg, unlawful possession of tax-paid whiskey, continued to October 1. John L. Flaherty, Southern Pines, driving drunk (second of fense) $200 and costs, license re voked two years. Clarence Edwin Deaton, Rob bins, driving drunk, careless and reckless driving, accident, $100 and costs, license revoked 12 months. Clarence W. Davis, Robbins, careless and reckless driving prayer for judgment continued 12 months on payment of $25 fine and costs. William Marvin Jackson, Eagle Springs, failui-e to yield right of way, causing accident, and Sarah Frances Nall, Biscoe, speeding, causing an accident with a school bus, prayer for judgment contin ued as to both defendants on pay ment of costs. John Phillip Hamilton, Fort Bragg, speeding 83, 60 days on roads, suspended on payment of $75 fine and costs, license revoked 12 months Lyndo Jackson, Carthage, care less and reckless driving, follow ing too closely, prayer for judg ment continued on payment of $25 fine and costs. John Duncan Johnson, Route 1, Cameron, careless and reckless driving, prayer for judgment con tinued on payment of $25 fine and costs. Dennis L. Green, Southern Pines, larceny of speedometer and other automobile parts, six months on roads, suspended on payment of $50 fine and costs. Charles Ray Marley, Route 2, Robbins, careless and reckless driving, causing an accident, driv ing on wrong side of road, three months on roads, suspended on payment of $50 fine and costs, also to pay medical bills o fplaintiffs and pay damages to plaintiff’s pick-up truck. Ted Rosser, Vass, gambling, costs. Johnny McIntosh, Vass, gamb ling, continued to next Monday. Walter Garner, Southern Pines, gambling, costs. T. V. Hatch, Southern Pines, gambling, costs. The $5 that was involved was ordered turned over to the General Fund of the Coun ty. Curtis H. Goins, Pinehurst, gambling, 30 days, suspended on Of Speeding In Recorder’s Court payment of $35 fine to include costs. Ray Burns, careless and reck less driving, speeding, driving without operator’s license, failure to stop, 60 days on roads, defend ant to be released if he can be admitted to a correctional institu tion. Willie Gamble, larceny of auto, state takes nol pros, in that de fendant has been bound to Supe rior Court. Eugene Mofield, Carthage, driv ing without operator’s license, $50 and costs. James Jackson, Southern Pines, leaving scene of accident and fail ure to report accident, prayer for judgment continued on payment of costs and the payment of dam ages to other car. Joseph Lee Newton, Carthage, driving drunk, $100 and costs, li cense revoked 12 months . Wayne Derryberry, Vernon L. Moon, and William Lester Ray, aU Robbins, unlawful possession of equipment and goods to manufac ture illegal whiskey. Moon and Ray, three months on roads, sus pended on payment of $25 fine each and one-half the costs each, both to be under supervision of State Probation Officer. As to Derryberry, three months on roads to run concurrently with sentence of six months on roads which was imposed in December, 1954. Car belonging to Moon to be turned over to his mother. Claude Alexander Kennedy, Carthage, driving drunk, unlawful possession of illicit whiskey, 60 days on roads, suspended on pay ment of $125 and costs, license re voked 12 months. Defendant filed notice of appeal to Superior Court, bond fixed at $350. S. F. Stewart, LiUington, driv ing without operator’s license, im proper equipment, $10 and costs. Rites Held Here Sunday For Mrs. Mary C. Benedict Mrs. Mary Cadwallader Bene dict, 80, died at her home in Pinebluff Saturday morning fol lowing a lengthy illness. Funeral services were held Sunday at 4 p. m. at Emmanuel Episcopal Church in Southern Pines, conducted by the Rev. Martin Caldwell, rector and as- sister by Dr. T. A. Cheatham of Pinehurst. Graveside service and burial followed Monday at 2 p. m. at Makefield Cemetery near Yard- ley, Pa. She was botn at Burlington, N. J., and grew up in Titusville, Pa., attending the Mary A. Bmnham School, Northampton, Mass. She was married in 1907 to the late Seldon S. Benedict of Titusville, Pa. In 1926 she became a winter resident of Pinebluff and became a permanent resident in 1936. She was a member of the Pine bluff Maternal Welfare Commit tee, Emmanuel Episcopal Church and Moore County Hospital Aux iliary. Surviving are one son, Cadwallader, associate editor of The Pilot, Southern Pines, and one grandson, Christopher. In Tribute For the great part of her years in Pinebluff, Mrs. Benedict had lived a retired life. It could have been called the life of a recluse, if the word did not have such gloomy connotations. For a life lived with the love of beauty, of flowers, of books, in the close companionship of loved ones, can not be gloomy. She was a person rich in her inner resources. Earlier, Mrs. Benedict had tak en an active part in the Maternal Welfare Committee work. She had enjoyed working for the clin ic and sewing layettes. Her grace of manner had made her welcome everywhere. A devout Episco palian, she had remained always close to her church, attending church as long as she was able. Mrs. Benedict had come to Pine- bluff a young girl of sensitivity and of great beauty. They were attributes which never left her. Throughout hed life, she retained a loveliness and a distinction that seeped through the wEills of the house she loved so much, to touch with a certain mysterious delica cy the community where she lived her quiet life.
