Both had their sentences sus pended on payment of fines of $250 and costs; both appealed to Superior Court. 'The trial consumed almost three hours of a longhand tiring day for the court. Toward the end of it Floyd, who lives near Asheboro, received a telegram advising him that his eight-year-old son had been run over and seriously in jured, Judge J. Vance Rowe, (Sympathetic With Floyd, allowed him to leave the court without posting the $500 bond required in the notice of appeal. Floyd left with his son, Buster, also a member of the band. Testimony in the case indicated that Floyd and Brown were clock ed by ABC Officer John K. Shmpe and Constable Oscar Bailey of West End. Floyd said that a “Jim Smith,” visiting in this area, was the driver but had returned to Baltimoije and probably could not be reached. Both officers said they had not seen a third party in the car. Solicitor W. Lament Brown, who has used the courtroom sev eral times to make pointed' and witty remarks with political over tones, asked: “Is Jim Smith any kin to Joe Smith? Survey Reveals Accidents Still Big Death Cause One out of every 13 deaths in North Carolina thus far in 1956 has been due to an accident, it was revealed today in figures re leased by the Accident Preven tion Section of the North Caro lina State Board of Health. Covering the first seven months of the year, official fig ures from the State Health De partment showed that all types of accidents caused 1,439 deaths as compared with 1,394 deaths during the corresponding period of 1955. Dr. Charles Cameron, Jr., acci dent epidemiologist of the Board of Health indicated that between January and August, 1956, motor vehicle accidents claimed 674 lives in the Tarheel state while 765 persons lost their lives in accidents in the home, on the farm, or in recreational or occupational activities. “While there has been an in crease of some 45 accidental deaths in 1956 over the previous year,” Dr. Cameron said, “when milk.
