Brown, 32, for breaking and entering a West Southern Pines store recently and he will be tried in Superior Court in the January term. Brown, a Laurinburg Negro, had been arrested in Wagram for breaking into Pugh’s Variety Shop November 26. Southern Pines po lice officer Robert Yonts worked on the case and gathered evidence that pointed to Brown as the per son who broke into the store and rifled the juke box and cigarette machine. Evidence in court Monday showed that Brown has been in trouble before and has a number of brushes with the law in Laurin burg. Other cases disposed of: Willie Robearts alias WlUije Rob ertson, Carthage, larceny of mer chandise from Lee’s Store, 18 months on roads, suspended on payment of costs and on condition he leave Moore County and not return during next five years. De fendant required to leave within 24 hoxirs, this suspended sentence at request of defendant. Manuel Antone, Fort Bragg, driving drunk, careless and reck less driving, accident, $100 and costs, license revoked 12 months. James Waylord Smith, West End, driving drunk, careless and reckless driving, improper equip ment, 60 days on roads, suspended on payment of $125 and costs, li cense revoked 12 months. Henry Hoover, Cameron; carry ing concealed weapon, larceny from McRae’s Grocery, six months on roads. It appears to court that defendant was convicted of as sault and battery July 2, 1956, and given 60 days on roads, which was suspended on payment of a fine and on good behavior conditions for 12 months and that he has vio lated the terms of that judgment. It is now ordered into effect to run concurrently with a term of six months here. Leon Green, Route 2, Candor, public drunk, unlawful possession. $15 and costs. Johnny W. Adams, Fort Bragg, driving without license, $10 and’ costs. Lillian Tyson, Southern Pines, driving without license (second offense), prayer lor judgment con tinued on payment of $25 and costs and on condition she not op erate a vehicle on the public high ways until she obtain proper li cense. Harley Dewey Mackie, Winston Salem, driving drunk, careless and reckless driving, no valid opera tor’s license, $100 and costs, li cense revoked 12 months. Eddie Lee Frye, Route 2, Car thage, driving drunk, careless and reckless driving, accident, proper ty damage and leaving scene of accident, not guilty of driving drunk or hit and run. Guilty of careless and reckless driving, 60 days on roads, suspended on pay ment of repair bills to other car. Laura M. Deyoe, Aberdeen, speeding $5 and; costs. Mack Monroe and Pauline Stro- man, both Southern Pines, the male defendant for violation of prohibition laws and transporting, the female for aiding and abetting. As to bpth, three months in jail, he to serve the time working on the public, roads. Both sentences suspended for two years on condi tion they, pay a joint fine of $50 and costs and be of good behavior next two years. The automobile to be forfeited and sold as provid ed by law with the funds to be turned over to the county school fund. Everette Ray Needham, larceny, breaking and entering, fraud, con tinued to next Monday. Defend ant also charged in other case with driving without operator’s license, also continued; bond fixed at $500. Franklin W. Lyle, Southern Pines, trespass, temporary larceny. From the evidence before the court, the court is of the opinion that the violation is only a techni cal violation. Prayer for judg ment continued on ' payment of costs and on further condition de fendant purchase and give, to Southern Pines school a basket ball of equal value to one he took. Mack Malone, Pinehurst, care less and reckless driving, failure to stop at stop sign, 30 days on roads, suspended on payment of $25 and costs. Carl Brady, Highfalls, assault with deadly weapon (chair) and threats. Nol pros. Kenneth Arnold Sandy, San ford, affray, creating disturbance, 60 days on roads, suspended for 12 months on payment of $25 and costs. W. E. Roe, Columbia, S. C., driv ing with improper license plates, $25 cash bond forfeited. Edward McMannen, Southern Pines, speeding 80 in 35 zone, three months on roads, suspended on payment of $100 and costs.
