Page SIXTEEN THE PILOT—Southern Pines, North Carolina THURSDAY, JULY 18, 1J57 IN RECORDER'S COURT Family Squabble Ends With Father And Wife, Son-In-Law Convicted A family squabble growing out of a young husband’s attempt to see his estranged wife took up a good portion of the afternoon cession of Moore Recorder’s Court Monday and ended with convictions handed down for the husband and his in-lawc. Joe Smith of Robbins, charged with making threats to do bodi ly harm, was given three months on the roads, and John Hack ney, his father-in-law, drew a similar sentence for assault with a deadly weapon. Both sentences were suspended, as was one against Mrs. Hackney, convicted of aiding and abetting her hus band in the assault. All were or dered to pay costs. The trouble started, testimony indicated, when young Smith went to the Hackney home Fri day and said he wanted to see his wife and child who were staying at the Hackney home. Mrs. Smith is a daughter of the Hackneys and has been staying there since the couple separated some time ago. Smith said Hackney greeted him at the door with a vile name. Hackney said Smith had called him the same name and had invited him into the yard so 'that be (Smith) “could stomp him to death.’’ Smith said Hackney went m side the house and returned car rying a shotgun with which he marched Smith about 75 feet off the Hackney yard. Two witness es corroborated the testimony. Hackney denied he ever held a shotgun on Smith. A neighbor testified she had heard, at one point during the argument, Hackney call to Smith and say: “I’ll kill you like I killed that other man.” He ad mitted to Solicitor W. Lamont Brown that he had indeed killed a man about 25 years ago and had served time for the killing. “It seems,” Hackney said “’that every time something happens around here somebody has some thing to say about me killing that man.” He said he had not been in court since then and had been living a peaceful life. Evidence and testimony also indicated that Mrs. Hackney stood close beside her husband during the argument, urging him to shoot. In pressing for convictions. Solicitor Brown said something should be done to “restrain these defendants. The ill wiU that has grown up could have developed into something bigger and could easily end in someone’s death.” Judge Rowe told Smith to stay away from the Hackney home until some peaceful arrange ments could be worked out for calmer visits. Other cases disposed of: GUbert Wiiliam Parrish, Car thage, driving drunk, careless and reckless driving, $100 and costs, license revoked 12 months. Elbert Lyman Faircloth, Pine- hurst, driving drunk, unlawful possession of seal broken whis key, $100 and costs, license re voked 12 months. Thornton Hailey (aUas Dock Hailey) and Floyd Hailey, Cam eron, resisting arrest. As to each defendant, 60 days on roads, sus'- pended in each instance for 12 months, on condition defendants pay a' $25 fine and costs, defend ants be of good behavior during suspension period, defendants not appear in a public place in a drunken condition, and on fur ther condition they pay medical expenses of treating Mr. Wood (he was bit by defendant’s dog and sustained a $4.50 medical bill). Frank Keith Shaver, West End, speeding, capias, returnable Mon day, bond $50. Walter Jenkins, non compli ance, case continued two weeks. Johnny B. McNeill, Vass, pub lic drunk, disorderly conduct, driving drunk and without oper ator’s license. Guilty of driving without operator’s license, but not of other charges. Fine of $25 and costs. Sgt. Charles Hartman, Fort Bragg, driving with improper muffler, improper license plates, trespass, threats, careless and reckless driving. Not guilty of trespass and assault. Guilty of careless and reckless driving, costs. Herman Thompson, failure to comply, ordered to prison for 30 days unless he pay costs by July 17. Jethro Brower, Eagle Springs, attempted assault, trespass, guil ty of simple assault and trespass, 30 days on roads, suspended on payment of $25 and costs. William Jenkins, Fort Bragg, no operator’s license, capias is sued; returnable next Monday, bond of $35. Raymond Roy Holt, Route 2, Cameron, abandonment and fail ure to support, it appearing to the court that the defendant and his wife have entered into a separa tion agreement ^d the wife states to the Court that she is perfectly satisfied with the agree ment, both she and the defendant being represented by counsel, the court orders a nol pros of the case upon the payment of costs.
