Man’s Trial on Serious Traffic Charge
Continued to Saturday^ for Witnesses
The trial of a 24-year-old San
ford man, William Carlyle, on
charges arising from an auto
truck accident the week before
Christmas, Was continued by
Judge J. Vance Rowe Monday in
Moore County Recorder’s Court,
for additional evidence to be pre
sented Saturday.
“The issues are so iniporlant
and the penalty so severe, the
court must have all available
evidence in order to determine
the truth,” said the judge, on find
ing—after conflicting testimony
was taken, that two vital witness
es were lacking.
Both Roger Medlin of Cameron
and William Edgar Spell, Jr., of
Carthage were in court last week,
it was learned, but when the case
was called this Monday Medlin
was out sick, while Spell had re
turned to college. Both were pres
ent at the scene of the collision
of which the vital issue became:
who was driving the Carlyle car,
the husband or wife?
This was critical as Carlyle,
whose record showed three con
victions of drunken driving, had
■ suffered permanent revocation of
his license as a result. He j was
charged this time with driving
without license, driving after per
manent revocation and careless
and reckless driving resulting in
accident. He himself was injured
in the crash.
Both husband and wife testified
that she was driving when their
car came over a hill on a rural
road east of Cameron and ran in
to the rear of a truck which had
stopped on missing its turnoff,
and was backing up to leave the
road.
The front of the Carlyle car was
driven up under the high rear
end of the truck, its hood peeled
back and its windshield shatter
ed. Both vehicles hurtled togeth
er 50 feet down the road. William
Spell was the driver of the truck,
while Medlin, the other absent
witness, came along a few sec
onds later.
William Gene Cole of Sanford,
Route 1, a passenger in the truck
and the first one out, said Mrs.
Carlyle jumped out of the right-
hand door of the smashed car
after which he and Medlin work
ed together to free Carlyle, who
was wedged against the left-han?
door, his legs pinned in behind
the steering shaft.
Carlyle said that actually he
was in the middle of the seat,
that his wife had scrambled out
of the driver’s seat and behind
him to get out on the other side
Both Mr. and Mrs. Carlyle had
been removed to Lee County Hos
pital at Sanforjd before Trooper
R. R. Samuels arrived on the
scene. 'They were questioned
there by Lee Trooper Price, who
said Mrs. Carlyle told him she
had been driving.
Solicitor W. Lamont Brown
insisted the evidence showed
Carlyle to have been in the driv
er’s seat, while Defense Counsel
H. F. Seawell, claimed, “It is just
the word of one against the other
and I don’t see how your evidence
can decide on the evidence given.”
Other cases disposed of:
Orville Curtis Vaughn, West
End, driving while drunk, 60 days
or $100 and costs, license revoked
12 months; Hiddreth Koogler,
speeding 75 in 60-mile zone, $15
and costs; Richard Greer Medford,
Jackson, Route 1, speeding 80 in
60-mile zone, 60 days or $60 and
costs, license revoked as provi
ded by law; Larry Ray Allred,
Robbins, Route 1, speeding in ex
cess of 90 in 55-mile zone, in care
less and reckless manner, failing
to stop at officers’ signal, three
months in jail to be assigned to
first offenders’ camp if possible,
otherwise to the roads, the sen
tence to begin at expiration of 60-
day sentence imposed and sus
pended July 31, now ordered into
commitment'; .Howard William
son, Robbins, Route 2, assault and
battery on wife, 30 days suspend
ed for 12 months on payment of
costs and on condition he refrain
from assaulting or otherwise mis
treating his wife.
James Downs, West End, search
warrant nol. pressed; unlawful
possession of illicit whiskey, 30
days suspended tor 13 months on
payment of $35 including costs
and non-violation of whiskey
laws; John Mabe, Troy, and Al
fred Lewis, Candor, larceny from
N. C. prison department, Lewis
acquitted, Mabe given six months
on roads, both acquitted on
charges of public drunkenness;
Bobby Lee Marsh, Ulysses Rob
erts, West End, probable cause
found for both on forgery charges,
bound over to superior court un
der $500 bond each; Alonzo Mc
Millan, Southern Pines, disposing
of mortgaged .property, amended
to charge obtaining money under
false pretense, probable cause
found, bound over to superior
court under $300 bond, acquitted
on speeding charge; Lonnell
Smith, Cameron, drunken driving,
no liability insurance, 60 days or
$100 and costs, license revoked 12
months.

the Daughters of the American
Revolution met on Saturday after
noon in the home of Mrs. Ralph
Chandler, Jr. of Southern Pines

were co-hostesses.
The table was beautiful with
a centerpiece of white flowers.

dra Cagle, the loyalty student of
the chapter, and her mother, Mrs.
Norman Cagle.
Guest speaker was Miss Jane
Owen of Robbins, an exchange
student who fecently returned
from France.
