Mrs. Hazel Cummings Wallace,
pleading not guilty in the pre
liminary hearing, made bond of
$300 set for all three cases.
The hearing had been begun
but had been continued, in the
court last month, when Judge
J. Vance Rowe decided, from the
evidence given at that time, that
further investigation was re
quired and more witnesses should
be subponeaed. Instructing the
sheriff to this effect, he scheduled
the hearing to be resumed this
week, when County Solicitor W.
Lament Brown would have re
turned from a European tour.
I The charges involved three
checks, two for $25 and one for
$20, forged in the name of N. M.
McKeithan, Aberdeen resident
with extensive farming interests
near Vass. Made payable to, and
showing purported endorsements
of, two brothers of Mrs. Wallace,
they had been cashed at various
places in Moore County. Mrs.
Wallace, testifying in her own be
half when the hearing was first
called, denied any knowledge of
the checks, but stated her belief
that at least one had been forged
by her son.
L. B. Horne, her teen-aged son
by a previous marriage, was
brought in Monday as a defen
dant, also charged with forgery,
but in view of his denials, and
without any sustaining evidence,
the case against him did not stand
up and he was released.
Additional withnesses subpon
eaed were Mrs. Wallace’s broth
ers “Dink” and “Buddy” Cum
mings, who also denied any
knowledge of the forgeries, or
having cashed or profited from
them in any way.
B-efore the son’s acquittal,
h;andwriting samples of both
mother and son were taken in
court and compared with the
checks, both apparently showing
some similarities with the checks
and with each other, though
nothing conclusive. Solicitor
Erown expressed his view that
th.a female defendant was dis
guising her handwriting, and the
case took an unexpected turn
when Roy Horne, her ex-husband,
then appeared in court, handing
the Solicitor a note which he said
was in his former wife’s “natur
al” hand. It had been written by
her to her son while she was held
in jail.
Comparison of this note with
the checks resulted in the finding
of probable cause against Mrs.
Wallacer Whether any further
handwriting analysis was plan
ned was not stated, and Judge
Rowe ordered the entire case file
locked up until the trial, as it
contained practically all the evi
dence in the case.
Assault Charges
Assaults of various types fea
tured Monday’s docket, also the
usual traffic offenses, including
one which appeared to sum up a
and costs, not to operate motor
vehicle on public highways dur
ing next 12 months, no law vio
lations; Howard Booth Rutledge,
N. C. State, Raleigh, careless and
reckless driving, unlawful pos
session of seal-broken whiskey,
$25 and costs.

driving, judgment continued on
payment of $25 and costs, defen
dant to obey traffic laws; Linda
Rebecca Arrington, Southern
Pines, driving without license,
$25 and costs; Mattie Cox, San
ford, Route 5, driving while
drunk, judgment continued on
payment of $100 and costs, license
revoked 12 months; Jimmie Gant
Horne, Rockingham, escaping
from prison, in view of sentence
recently imposed in Richmond
county for offenses connected
with this escape, this court im
poses sentence of only 60 days;
Mike Daugherty, Carthage, and
Wii'lliam McPhail, Raeford, as
sault and battery on female, ma
licious damage, not guilty; How
ard Carson Campbell, Cameron,
Route 1, driving while drunk,
after license suspension, not guil
ty; Johnny Richard Livingston,
Pope AFB, speeding 70 in 55-
mile zone, 30 days or $25 and
costs, not guilty of careless and
reckless driving.

gan, Star, Route 1, malicious des
truction of property, Williams
also charged with assault and
battery, and assault on a female,
judgment continued in both
cases until next Monday when
defendants are to be tried
on larceny charges, Williams to
be held until then under $750
cash bond, Morgan’s bond of
$1,000 already made to be con
tinued until Monday; Henry Mc
Leod, assault on female, the pros
ecuting witness Kate McLeod
failing to appear when the case
was called, subpoena ordered to
issue for her for show cause hear
ing next Monday; Alton McCrim-
mon, assault and battery on son,
judgment continued on payment
of costs and good behavior toward
all his family during next two
years; James Martin, assault with
deadly weapon (glass), prosecut
ing witness failing to appear, sub
poena ordered to issue requiring
him to appear in court next Mon
day to testify in this case; Eugene
Martin, assault with deadly wea
pon, called and failed, capias to
issue returnable next Monday, a
good justified or cash bond of
$250 required for his appearance;
Irving Peele, assault with deadly
weapon, nol pros with leave (de
fendant in state hospital); Charles
E. Blackwell, violation of judg
ment, capias dismissed (defen
dant having already served the
30, days’ sentence in this case);
Otis Brower, assault on a female,
costs; Rufus Hampton, Eagle

was handed a six months’ road
